Article 104. Establishment of the minimum wage of the Labor Code of the Republic of Kazakhstan
1. The minimum monthly wage is calculated based on the methodology for determining the minimum monthly wage.
The draft methodology for determining the minimum monthly wage is to be considered at a meeting of the Republican Tripartite Commission on Social Partnership and Regulation of Social and Labor Relations.
1-1. The minimum monthly wage should not be lower than the subsistence level, include additional payments and allowances, compensation and social benefits, bonuses and other incentive payments and should be carried out in proportion to the time worked.
1-2. The minimum monthly salary is set annually for the corresponding fiscal year by the law on the republican budget.
2. The minimum hourly wage of an employee who has completed his work duties may not be lower than the minimum monthly wage divided by the average monthly number of working hours according to the balance of working hours for the corresponding calendar year.
3. The minimum monthly salary or the amount of the monthly tariff rate of a first-class employee stipulated by the terms of labor, collective agreements and (or) acts of the employer may not be lower than the minimum monthly salary established for the relevant financial year by the Law of the Republic of Kazakhstan on the republican budget.
