Article 105. Establishment of the Civil Code of the Republic of Kazakhstan

     1. An institution is an organization established and funded by its founder, unless otherwise provided by legislative acts of the Republic of Kazakhstan, for the implementation of managerial, socio-cultural or other non-commercial functions.

 

     2. A state institution is an institution established by the state in accordance with the Constitution of the Republic of Kazakhstan and the laws of the Republic of Kazakhstan or legal acts of the President of the Republic of Kazakhstan, the Government of the Republic of Kazakhstan and local executive bodies of regions, cities of republican significance, the capital, districts, cities of regional significance, as well as the offices of akims of cities of regional significance, villages, towns, rural districts and contained only at the expense of the budget or budget (cost estimates) of the National Bank of the Republic of Kazakhstan, if additional sources of financing are not established by the laws of the Republic of Kazakhstan.

     3. The acceptance of contractual obligations by a state institution is carried out in accordance with the Budget Code of the Republic of Kazakhstan.

     4. The legal status of institutions is determined by this Code, the legislative act of the Republic of Kazakhstan on state property and other legislative acts of the Republic of Kazakhstan.
