Article 107. Comprehensive urban planning expertise of urban development projects of the Building Code of the Republic of Kazakhstan

1. Comprehensive urban planning expertise of urban development projects is carried out by a state expert organization consisting of certified experts in the relevant sections (parts).

2. Urban planning projects undergo a comprehensive urban planning examination of urban planning projects in accordance with the procedure determined by the authorized body for architecture, urban planning and construction.

3. Urban development projects are sent for a comprehensive urban planning examination of urban development projects by the customers of these projects with a full set of documents in accordance with the rules for conducting a comprehensive urban planning examination of urban development projects. The customer is responsible for the accuracy of the documents submitted for the comprehensive urban planning expertise of urban development projects.

4. Comprehensive urban planning expertise of urban development projects consists in analyzing and evaluating the quality of urban development projects by establishing the compliance (non-compliance) of design solutions with the conditions of the source materials for design provided for by the legislation of the Republic of Kazakhstan, including checking the availability of a protocol of public and public hearings and discussions of the urban development project with the public as part of the source materials, as well as compliance in the design decisions and calculations of requirements of urban planning and technical regulations, norms and regulations of state and interstate regulatory documents.

5. When making changes and (or) additions to approved urban development projects (adjustments), a comprehensive urban planning examination of urban development projects is carried out in accordance with this article.

6. The customers of the comprehensive urban planning expertise of urban development projects are:

the authorized body for Architecture, Urban Planning and Construction – for projects of national importance;

local executive bodies – for projects of regional importance and projects for the development and development of settlements.

The customer of urban development projects is also the customer of the comprehensive urban planning expertise of urban development projects for this urban development project without the right to delegate these powers to third parties.

7. Based on the results of a comprehensive urban planning examination of urban planning projects, a positive or negative expert opinion is issued on the basis of an agreement concluded with customers, in accordance with the procedure determined by the authorized body for architecture, urban planning and construction. The issuance of other types of expert opinions is prohibited.

8. Positive expert opinions of the comprehensive urban planning expertise of urban development projects are the basis for the approval of urban development projects.

9. The validity period of an expert opinion on an urban development project is limited by the validity period of this project.

10. In case of disagreement with the results of the comprehensive urban planning examination of urban development projects, the customer has the right to appeal the expert opinion to the court.

11. The organization of the process of conducting a comprehensive urban planning examination of urban development projects is carried out on the site of the portal for the organization of the development and examination of projects on the principle of "one window".

12. The State expert organization sends information about the issued negative conclusions on urban planning projects to the authorized body for architecture, urban planning and construction in accordance with the procedure determined by the authorized body for Architecture, Urban Planning and Construction.
