Article 111. Remuneration for the combination of positions, expansion of the service area and performance (replacement) of duties of a temporarily absent employee of the Labor Code of the Republic of Kazakhstan

Article 111. Remuneration for the combination of positions, expansion of the service area and performance (replacement) of duties of a temporarily absent employee of the Labor Code of the Republic of Kazakhstan  

     1. Employees who perform additional work in another or the same position or duties of a temporarily absent employee in the same organization along with their main work stipulated by an employment contract, without being released from their main work, shall be paid an additional fee.

     2. Additional work assigned to employees may be carried out by:

     1) combining positions – the employee performs, along with his main work provided for in the employment contract (job description), additional work for another vacant position.;

     2) expansion of service areas – the employee performs, along with his main work provided for in the employment contract (job description), additional work during the established working day (shift); -Excluded by the Law of the Republic of Kazakhstan dated April 7, 2026 No. 277-VIII SAM  

     3) fulfilling (replacing) the duties of a temporarily absent employee – the employee performs, along with his main work provided for in the employment contract (job description), additional work in both another and the same position.

     No additional payment is made to employees for performing (replacing) the duties of a temporarily absent employee if the replacement of a temporarily absent employee is part of the official duties of the substitute employee.

     3. The amount of additional payments for combining positions, expanding the service area, or fulfilling (replacing) the duties of a temporarily absent employee is determined by the employer in agreement with the employee based on the amount of work performed.

     4. The employee has the right to refuse to perform additional work, and the employer has the right to cancel the order for its performance, notifying the other party no later than three working days before the termination of additional work.

     In case of early cancellation of an assignment or refusal to perform additional work by an employee, the employer is obliged to pay the employee wages for the period worked.
