Article 12. Competence of local representative and executive bodies of oblasts, cities of republican significance, the capital and districts, cities of regional significance of the Code on the Health of the People and the Healthcare System
1. Local representative bodies of regions, cities of republican significance and the capital:
1) determine the system of social support measures for medical and pharmaceutical workers sent to work in rural areas and towns, cities of district and regional significance, as well as the procedure and amount of social support provided to them from budgetary funds;
2) approve local health and medical education budgets and reports on their implementation;
3) make a decision on providing free or preferential travel to citizens of the Republic of Kazakhstan outside the locality of permanent residence to receive high-tech medical services within the guaranteed volume of free medical care and (or) medical care in the compulsory social health insurance system;
4) take measures to provide transportation in the case of traveling medical care to the population within the guaranteed volume of free medical care and (or) in the system of compulsory social health insurance or reimbursement of transportation costs when traveling to provide medical care in rural areas;
5) make a decision on the additional provision of a guaranteed amount of free medical care, including medicines, specialized medical products, medical devices, to certain categories of citizens of the Republic of Kazakhstan during outpatient treatment for free and (or) on preferential terms;
5-1) decide on the provision of hearing prosthetic care for medical reasons to persons without disabilities;
6) approve measures aimed at the development and functioning of healthcare organizations, including organizations providing medical care to persons held in pre-trial detention facilities and institutions of the penal (penitentiary) system;
7) determine measures for staffing public health organizations based on the population in the relevant administrative-territorial units;
8) decide on providing additional incentives to donors;
9) make a decision on additional personnel and logistical support for public health organizations in excess of the minimum standard of provision of medical workers in the region approved by the authorized body to provide the population with medical care;
10) plan the staffing of the region with medical workers and place an order for the training of medical workers in medical education organizations;
11) monitor the provision of social support measures, as well as the training and retention of young professionals who have arrived from medical education organizations;
12) promote the formation of a healthy lifestyle and healthy diet;
13) approve the costs of carrying out measures for the prevention of iodine deficiency diseases as part of local budgets;
14) hear information from the heads of local executive bodies of regions, cities of republican significance and the capital, and healthcare organizations on the state of work on the prevention of iodine deficiency diseases;
15) exercise other powers to ensure the rights and legitimate interests of citizens of the Republic of Kazakhstan in accordance with the legislation of the Republic of Kazakhstan.
2. Local executive bodies of regions, cities of republican significance and the capital:
1) implement the state policy in the field of healthcare in the territory of the relevant administrative-territorial unit;
2) ensure the realization of the rights of individuals to receive a guaranteed amount of free medical care;
2-1) provide hearing prosthetic care for people without disabilities for medical reasons;
3) monitor the detention of persons in temporary adaptation and detoxification centers;
4) ensure the activities of healthcare organizations that are communal legal entities;
5) organize a set of measures to promote a healthy lifestyle;
6) ensure effective planning and use of healthcare resources;
6-1) establish medical rehabilitation centers (departments) for children with disabilities in cities of republican and regional significance, the capital, as well as district centers, including at facilities of the existing infrastructure of healthcare entities in these settlements, in order to provide rehabilitation services in accordance with the standard of organization of medical rehabilitation, rules of medical care;
7) take measures to improve the quality of medical services;
8) provide public access to information on health issues;
9) ensure the implementation of measures for the development of voluntary gratuitous blood donation and its components;
10) pay for travel within the country according to the list determined by local representative bodies of regions, cities of republican significance and the capital, for certain categories of citizens of the Republic of Kazakhstan traveling outside the locality of permanent residence to receive high-tech medical services within the guaranteed volume of free medical care and (or) medical care in the compulsory social health insurance system;
11) create local public health management bodies;
12) appoint and dismiss the heads of local public health management bodies of regions, cities of republican significance and the capital;
13) organize control over the staffing of public health organizations;
14) take measures to ensure the staffing of public health organizations, including measures of social support and retention of young professionals;
15) take measures for the construction and development of a network of healthcare organizations, their financial and logistical support, including the development of a state network of pharmacies and the creation of pharmacy warehouses;
16) coordinate the activities of healthcare entities within the relevant administrative-territorial unit;
17) ensure the provision of free medical care with medicines and medical products in emergency situations, the introduction of a state of emergency;
18) carry out interregional cooperation in the field of healthcare;
19) provide training and advanced training of personnel in the field of healthcare;
20) carry out activities necessary to promote health, prevent diseases, form a healthy lifestyle and a healthy diet;
21) organize the provision of medical care to the population, including the prevention and treatment of socially significant diseases and diseases that pose a danger to others, including drug provision within the guaranteed volume of free medical care;
21-1) organize the provision of medical care to persons held in pre-trial detention facilities and institutions of the penal (penitentiary) system, including the prevention and treatment of socially significant diseases and diseases that pose a danger to others, including medication;
21-2) organize provision of medicines and medical products in rural settlements where there are no pharmacies.;
21-3) organize the provision of psychological assistance to persons who have committed an administrative or criminal offense involving violence in healthcare organizations;
22) ensure that children with disabilities are referred for psychological, medical and pedagogical consultations with the consent of their parents or other legal representatives;
23) exercise state control in the field of healthcare within their competence;
24) excluded by the Law of the Republic of Kazakhstan dated 12/30/2022 No. 177-VII (effective ten calendar days after the date of its first official publication);
25) assist in the execution of a court decision on the referral of citizens of the Republic of Kazakhstan with tuberculosis for compulsory treatment;
26) organize and carry out preventive disinfection and deratization with an assessment of their effectiveness (with the exception of disinfection and deratization on the territory of natural foci of infectious and parasitic diseases, as well as in foci of infectious and parasitic diseases);
27) train specialists with medical education to sell medicines and medical devices in rural settlements through pharmacy centers in healthcare organizations providing primary health care, specialized medical care on an outpatient basis, and mobile pharmacy centers in the absence of a specialist with pharmaceutical education;
28) ensure the implementation of measures for the development of voluntary gratuitous donation of organs (parts of organs) and (or) tissues (parts of tissues);
29) approve the regional long-term plan for the development of healthcare infrastructure in coordination with the authorized body;
30) establish medical commissions to conduct medical examinations of citizens of the Republic of Kazakhstan in the interests of military service and ensure their activities;
31) organize the provision of iodized food salt and other food products enriched with iodine compounds to preschool organizations, educational organizations, healthcare organizations, and social protection organizations.;
32) carry out activities for the formation, monitoring of the implementation and evaluation of the results of the state social order in the field of public health protection for non-governmental organizations, including for key population groups;
33) place a state social order for the provision of palliative care, with the exception of palliative care;
34) award the "best by profession" nomination; - Excluded by the Law of the Republic of Kazakhstan.
35) ensure the creation of conditions for the placement of interns and resident doctors in healthcare organizations of the relevant administrative-territorial unit, including the provision of a place of residence and medical care for interns and resident doctors (if the healthcare organization is located in another locality with an organization of higher and (or) postgraduate education);
36) organize the safe disposal of medical waste;
37) develop a network of healthcare organizations and implement regional long-term plans for the development of healthcare infrastructure;
38) ensure the implementation of state programs for the development of the healthcare system, as well as the implementation of measures in the field of healthcare and decisions of the National Coordinating Council for Health Protection under the Government of the Republic of Kazakhstan;
39) ensure the creation and functioning of regional electronic information resources and information systems, information and communication networks in the field of healthcare;
40) exercise, in the interests of local government, other powers assigned to local executive bodies by the legislation of the Republic of Kazakhstan.
3. Local executive bodies of districts and cities of regional significance shall take measures to ensure the staffing of public health organizations, including measures of social support and retention of young professionals.
