The competence of the Ministry of Justice of the Republic of Kazakhstan includes:

1) implementation of the state policy in the field of forensic expertise;

2) implementation of state control in the field of forensic expertise;

3) development and approval of the list of types of forensic examinations conducted by forensic examination bodies and expert specialties, qualifications for which are assigned by the Ministry of Justice of the Republic of Kazakhstan;

4) development and approval of rules for the organization and conduct of forensic examinations and research in the judicial examination bodies;

5) development and approval of rules for handling objects of forensic examination;

6) development and approval of rules for determining the complexity categories of forensic examinations, the procedure for calculating the time limits for conducting forensic examinations depending on their complexity category, as well as the grounds and procedure for suspending and extending the time limit for conducting forensic examinations;

7) development and approval of standards for the workload of judicial experts of judicial examination bodies;

8) development and approval of rules for determining the cost of conducting a forensic examination in the judicial examination bodies;

9) development and approval of rules for the validation of methods and techniques of forensic research;

10) development and approval of rules for the development, testing and implementation of forensic research methods;

11) development and approval of rules for the formation, maintenance and use of the State Register of Forensic Research Methods of the Republic of Kazakhstan;

12) maintaining the State Register of methods of forensic expert research of the Republic of Kazakhstan;

13) development and approval of standards and requirements for specially equipped facilities for forensic examination;

14) development and approval of rules for qualification training of judicial experts;

15) development and approval of the rules for admission of examinations for the qualification of a judicial expert;

16) development and approval of the regulations on the commission for the qualification of a judicial expert and its composition;

17) admission of qualification exams for the qualification of a judicial expert;

18) development and approval of rules for the certification of judicial experts;

19) development and approval of the regulations on the commission for the certification of judicial experts and its composition;

20) certification of judicial experts;

21) development and approval of rules for professional development of judicial experts;

22) development and approval of rules for the formation, maintenance and use of the State Register of Judicial Experts of the Republic of Kazakhstan;

23) maintaining the State Register of Judicial Experts of the Republic of Kazakhstan;

24) development and approval of the regulations on the commission for licensing of forensic expertise and its composition;

25) licensing in the field of forensic expertise;

26) development and approval of the Code of Ethics of a Judicial expert;

26-1) development and approval of a professional standard in the field of forensic expertise;

27) other powers provided for by this Law, other laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan.

Article 12 as amended by the Law of the Republic of Kazakhstan dated 07/04/2023 No. 15-VIII (effective after sixty calendar days from the date of its first official publication).

This Law regulates public relations in the implementation of forensic expertise in the Republic of Kazakhstan.
