Article 12. The main tasks and functions of the State Commission The Law On the State of Emergency

     1. The main tasks of the State Commission are:

      1) elaboration of measures to eliminate the circumstances that served as the basis for the introduction of a state of emergency;  

      2) organization of operational measures to manage and ensure the activities of the territory where the state of emergency has been introduced;  

      3) organization of accommodation of individuals affected by the circumstances that served as the basis for the introduction of a state of emergency in residential premises for temporary residence, provision of necessary assistance;  

      4) coordination of the activities of central and local executive bodies, organizations, and commandant's offices of the locality where the state of emergency has been imposed, to eliminate the circumstances that served as the basis for the introduction of the state of emergency;  

      5) control over the implementation of measures carried out during the state of emergency.  

      2. To fulfill the main tasks, the State Commission performs the following functions::  

      1) develops proposals for coordinating the activities of central and local executive bodies, organizations, and commandant's offices of the locality where the state of emergency has been imposed, and for eliminating the circumstances that served as the basis for the introduction of the state of emergency;  

      2) hears officials of central and local executive bodies and commandants of localities where a state of emergency has been imposed on the implementation of tasks assigned to the State Commission.;  

      3) requests and receives from central and local executive bodies and organizations the documents and information necessary for the implementation of the activities of the State Commission;  

      4) controls the implementation by central and local executive bodies, organizations, and commandant's offices of the locality where the state of emergency has been introduced of measures to eliminate the circumstances that served as the basis for the introduction of the state of emergency;  

      5) engages specialists from central and local executive bodies and organizations to perform analytical, expert and other work necessary to resolve issues related to the elimination of circumstances that served as the basis for the introduction of a state of emergency;  

      6) considers the effectiveness of the introduction of additional measures and time limits specified in Articles 15, 16 of this Law. In case of complete or partial elimination of the circumstances that served as the basis for the introduction of a state of emergency, submits appropriate proposals to the President of the Republic of Kazakhstan on the complete or partial abolition of additional measures, temporary restrictions or a state of emergency.;

     7) appeals to the President of the Republic of Kazakhstan with proposals on the need to apply the Armed Forces of the Republic of Kazakhstan, additional measures and time restrictions provided for by this Law in the area where a state of emergency has been imposed, and ensures their implementation;

     8) coordinates the activities of local executive bodies, organizations, territorial internal affairs bodies, territorial bodies of the authorized body in the field of civil protection, military formations located (stationed) in the area where a state of emergency has been imposed, and additionally involved state bodies to ensure a state of emergency.

 

 

The Law of the Republic of Kazakhstan dated February 8, 2003 No. 387.

     This Law establishes the grounds, terms, procedure for the introduction and operation of a state of emergency throughout the territory of the Republic of Kazakhstan or in its individual localities, and the legal regime of a social emergency.
