1. The provisions of this Law apply to all banks operating in accordance with the legislation of the Republic of Kazakhstan, including those established in a special manner on the basis of separate regulatory legal acts regulating the initial stage of their organization, as well as to persons who are direct and indirect shareholders (participants) of banks.

2. Banks and other legal entities operating within the framework of the special regulatory regime introduced in accordance with the Law of the Republic of Kazakhstan "On State Regulation, Control and Supervision of the Financial Market and Financial Organizations", the norms of this Law and regulatory legal acts of the authorized body, the National Bank of the Republic of Kazakhstan, adopted in accordance with this Law, shall apply within the limits stipulated by the conditions of the special regulatory regime.

The provisions of the first part of this paragraph do not apply to branches of non–resident banks of the Republic of Kazakhstan.

3. Paragraph 3 of Article 6 of this Law applies to banks that have received funds from the state budget, the National Fund of the Republic of Kazakhstan, the National Bank of the Republic of Kazakhstan and (or) its subsidiaries prior to the date of entry into force of this Law.
