Article 133. Ownership of lands of the water fund and land plots occupied by water management facilities of the Land Code of the Republic of Kazakhstan

1. The lands of the water fund are owned by the people of Kazakhstan.

On behalf of the people of Kazakhstan, the right of ownership is exercised by the State. At the same time, the exercise of the right of ownership by the state is implemented through the state ownership regime in the interests of the people of Kazakhstan.

2. Land plots occupied by water management facilities (irrigation and drainage systems) of interdistrict (regional) and inter-farm (district) significance, as well as irrigation facilities serving the land plot of one economic entity, may be privately owned by citizens and non-governmental legal entities of the Republic of Kazakhstan in the event of alienation from state ownership of these facilities.

3. Land plots for water management facilities listed in paragraph 2 of this Article, serving two or more owners of land plots or land users, are provided to them on the right of common ownership or common land use.
