Article 14. Duties of the Customs authorities of the Code on Customs Regulation in the Republic of Kazakhstan
1. Duties of customs authorities:
1) to protect the interests of the state within its competence;
2) to observe the legitimate rights of declarants and persons engaged in activities in the field of customs;
3) consider complaints against decisions, actions (inaction) of the customs body and (or) officials of the customs body in the manner and within the time limits established by the legislation of the Republic of Kazakhstan;
4) to promote the development of foreign trade by creating conditions conducive to accelerating trade across the customs border of the Eurasian Economic Union;
5) to carry out customs control in respect of goods and vehicles transported across the customs border of the Eurasian Economic Union;
6) excluded by the Law of the Republic of Kazakhstan dated December 28, 2018 No. 210-VI (effective ten calendar days after the date of its first official publication);
7) to provide, within the limits of their powers, assistance to declarants and persons engaged in activities in the field of customs affairs in the exercise of their rights;
8) ensure the completeness of collection and timely transfer of customs payments, taxes, special, anti-dumping, countervailing duties to the budget;
9) to make decisions within their competence within the time limits established by this Code and to monitor the activities of declarants and persons engaged in activities in the field of customs affairs, to comply with the conditions and obligations established by the customs legislation of the Eurasian Economic Union and (or) the Republic of Kazakhstan, as well as other legislation of the Republic of Kazakhstan;
10) to maintain customs statistics of foreign trade and special customs statistics of the Republic of Kazakhstan;
11) ensure, within its competence, the protection of the customs border of the Eurasian Economic Union and control over compliance with the customs and other legislation of the Republic of Kazakhstan;
12) to ensure, in accordance with the legislation of the Republic of Kazakhstan, protection from illegal actions in relation to the activities of customs authorities, customs officials and their family members;
13) to carry out work on the prevention, suppression and detection of offenses within the limits of their competence;
14) to collect and analyze information on the commission of offenses in the field of customs affairs;
15) implement, in cooperation with national security agencies and other relevant state bodies of the Republic of Kazakhstan, measures to ensure the protection of the customs border of the Eurasian Economic Union;
16) ensure timely, objective and comprehensive consideration of applications and the submission of responses or the implementation of appropriate actions, taking into account incoming requests and proposals in the field of customs;
17) provide free information and advice in the field of customs affairs;
18) interact with other state bodies of the Republic of Kazakhstan in accordance with the procedure determined by the legislation of the Republic of Kazakhstan, as well as on the basis of joint acts of the relevant state bodies of the Republic of Kazakhstan in coordination with these bodies;
19) to cooperate in order to improve customs affairs and introduce effective customs administration methods with participants in foreign economic and other activities, their associations (unions), the National Chamber of Entrepreneurs of the Republic of Kazakhstan, as well as non-profit organizations;
20) provide the authorized body in the field of environmental protection with information on importers, indicating their legal addresses, volumes and types of products (goods) imported into the territory of the Republic of Kazakhstan, which are subject to extended obligations of manufacturers (importers) in accordance with the legislation of the Republic of Kazakhstan;
21) collect the amounts of customs duties and taxes not paid to the budget on time, as well as penalties and interest;
22) carry out customs administration in accordance with the customs legislation of the Eurasian Economic Union and (or) the Republic of Kazakhstan;
23) to ensure the safety of goods that have become the property of the state before the transfer of such goods to the authorized state bodies of the Republic of Kazakhstan in accordance with the legislation of the Republic of Kazakhstan.

2. The customs authorities shall also carry out other duties stipulated by this Code, other laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan.
3. When the customs authorities identify criminal and (or) administrative offenses, the proceedings on which are attributed in accordance with the legislation of the Republic of Kazakhstan to the competence of other state bodies of the Republic of Kazakhstan, the customs authorities, in accordance with the procedure and within the time limits provided for by the legislation of the Republic of Kazakhstan, are obliged to transfer the materials available on such offenses to the relevant state bodies of the Republic of Kazakhstan.
