Article 14. Management of communication networks in emergency situations, the introduction of a state of emergency The Law on Communications

      1. The management of communication networks in the event of a threat or emergency of a social, natural or man-made nature, as well as the imposition of a state of emergency, is carried out in accordance with the legislation of the Republic of Kazakhstan by the authorized body in cooperation with state bodies according to the list determined by the Government of the Republic of Kazakhstan, which have the right to priority use, as well as suspension of the operation of networks and means of communication, except for with the exception of government and presidential communications, emergency service networks and communications facilities, in accordance with paragraph 1-2 of Article 41-1 of this Law.

      2. Reimbursement of costs incurred by telecom operators when using their networks and means of communication in the event of a threat or emergency of a social, natural or man-made nature, as well as the imposition of a state of emergency, is carried out in accordance with the procedure determined by the Government of the Republic of Kazakhstan.  

     3. Owners of networks and means of communication should give absolute priority to all communications concerning the safety of human life at sea, on land, in the air, in outer space, urgent measures in the field of defense, security and law enforcement in the Republic of Kazakhstan, as well as emergency situations.

     4. Telecom operators are obligated, free of charge, to provide the 112 unified duty and dispatch service with services for determining the caller's location and sending short text messages to cellular subscriber devices of the population in case of threat or occurrence and removal of the threat of social, natural and man-made emergencies, the imposition of a state of emergency, in the interests of defense, security and law and order. The procedure for using the networks of telecom operators for these purposes is determined by the authorized body.

     5. In the event of a threat and (or) occurrence of a social, natural or man-made emergency, as well as in the event of a state of emergency, telecom operators are required to provide mobile communication stations at their disposal upon request from operational headquarters.

     6. Mobile operators ensure the operation of the technology of broadcast transmission of messages on their networks.

 

 

The Law of the Republic of Kazakhstan dated July 5, 2004 No. 567.

     This Law establishes the legal basis for activities in the field of communications in the territory of the Republic of Kazakhstan, defines the powers of state bodies to regulate these activities, the rights and obligations of individuals and legal entities providing or using communications services.
