Article 143. General provisions on postutilization (demolition) construction sites of the Building Code of the Republic of Kazakhstan
1. Postutilization (demolition) of a construction site is carried out on the basis of a decision of the owner of the construction site or, in cases provided for by this Code, other laws of the Republic of Kazakhstan, on the basis of a judicial act that has entered into legal force, or a decision of a local executive body, unless otherwise provided for in paragraph 2 of this article.
2. The basis for the demolition of a construction site included in the list of construction sites to be demolished is urban development and development projects of settlements.
3. In order to postulate (demolition) The contractor (general contractor) or the customer shall ensure the preparation of a construction project for the organization of demolition work on the construction site as an independent document, with the exception of the cases provided for in paragraph 4 of this article. Preparation of a construction project for the organization of work on postutilization (demolition) The construction project is carried out by a design organization or a certified specialist in the field of architectural, urban planning and construction activities, information about which is included in the register of specialists.
4. Preparation of a construction project for the organization of work on postutilization (demolition) The construction site is not required for post-construction (demolition) construction facilities specified in paragraph 4 of Article 98 of this Code. In this case, the contractor (general contractor), on his own initiative, has the right to ensure the preparation of the organization of work on the postutilization (demolition) such construction sites.
5. Preparation of a construction project for the organization of work on postutilization (demolition) The construction site is carried out on the basis of the results and materials of the survey of the construction site in accordance with the requirements of technical regulations, sanitary and epidemiological requirements, environmental protection requirements, safety requirements for activities in the field of atomic energy use, and requirements for activities in the field of industrial safety.
6. Requirements for the composition and content of the construction project for the organization of work on postutilization (demolition) The construction site is established by the authorized body for architecture, urban planning and construction.
7. If the postutilization (demolition) of a construction site is planned to be carried out with the involvement of public investments, the contractor (general contractor) or the customer ensures the preparation of the estimated cost of construction.
8. If the demolition of a construction object located on a land plot owned by the state and for which the right of land use has not been granted in accordance with the legislation of the Republic of Kazakhstan is provided by a state body or a local executive body, the functions of the contractor (general contractor) are performed by the specified bodies or persons with whom the specified bodies have concluded a demolition agreement such a construction site.
