Article 15. Admission to the administrative civil service of the Law on Civil Service of the Republic of Kazakhstan

1. The occupation of an administrative public position is carried out on a competitive basis, except for the cases provided for by this Law, as well as appointment by local representative bodies or election in accordance with the laws of the Republic of Kazakhstan.

2. The appointment to an administrative public position of citizens who enter the civil service for the first time or who re-enter after its termination is carried out after receiving positive results of a special check.

2-1. A civil servant is not considered to have re-entered public service after its termination if he holds a public position no later than the next working day after his dismissal from his previous position.

In this case, the civil servant is not subject to the requirements for mandatory special inspection, the establishment of a probation period and the submission of a declaration of income and property belonging to him by right of ownership.

3. Without holding a competition, by the decision of the authorized commission, the following persons may occupy administrative public positions of the "B" building:

1) current judges, members of Parliament, deputies of maslikhats who work on a permanent basis, political civil servants, international employees who perform their duties for at least six months;

2) international employees, judges who have served for at least six months and terminated their powers, with the exception of those who terminated their powers for negative reasons;

3) political civil servants who have been exercising their powers for at least six months and have terminated them, with the exception of those who terminated their powers for negative reasons, provided that their positions are classified as political public positions in accordance with the register of positions of political and administrative civil servants in force at the time of the decision of the authorized commission;

4) persons with at least five years of work experience in international, foreign or transnational organizations, foreign government structures;

5) persons who have at least two years of professional experience and have completed their doctoral studies (PhD, doctor in profile) at leading foreign higher educational institutions, as determined by the Republican Commission for Personnel Training Abroad;

6) Excluded by the Law of the Republic of Kazakhstan dated 03/20/2023 No. 214-VII (effective ten calendar days after the date of its first official publication).

7) persons enrolled in the Presidential Youth Personnel Reserve.

Administrative civil servants of building "A" who meet the established qualification requirements may take up administrative public positions of building "B" without holding a competition in agreement with the authorized body.

3-1. Excluded by the Law of the Republic of Kazakhstan dated 07/03/2020 No. 357-VI (effective ten calendar days after the date of its first official publication).

3-2. Persons enrolled in the regional personnel reserve of the region, the city of republican significance, the capital, may take up administrative government positions of building "B" of local executive bodies in coordination with the authorized body or its territorial subdivision without holding a competition.

The formation of the regional personnel reserve of the region, the city of republican significance, the capital and the appointment from it are carried out in accordance with the procedure determined by the President of the Republic of Kazakhstan.

4. Akims of a city of regional significance, village, settlement, rural district may hold administrative public positions of building "B" in accordance with the legislation of the Republic of Kazakhstan on public service within one year after the end of their term of office in coordination with the authorized body or its territorial subdivision without holding a competition.

Persons who have completed their studies and passed the qualification exam at the Academy of Justice under the Supreme Judicial Council of the Republic of Kazakhstan may take up administrative government positions of corps "B" in the authorized state body in the field of judicial administration and its territorial divisions in the regions, in accordance with the legislation of the Republic of Kazakhstan on public service, within one year after graduation, in coordination with the authorized body or its territorial subdivision, without holding a competition.

5. Persons who have completed their studies at educational institutions under the President of the Republic of Kazakhstan under a state order for postgraduate education programs with a study result not lower than the value established by the authorized body may hold administrative government positions of corps "B" in local executive bodies, maslikhat offices, audit commissions, territorial divisions of central government bodies and their departments (except for local executive bodies, maslikhat staff, audit commission, territorial divisions of central government bodies and their departments in the capital and its districts) within one year after graduation in coordination with the authorized body or its territorial division without holding a competition.

6. Persons who have completed their studies in educational institutions within the framework of a state order for higher and (or) postgraduate education programs with a study result not lower than the value established by the authorized body may, within one year after completing this training, take up the following administrative government positions in Building B without holding a competition:

1) the lower-level position of the akim and maslikhat offices of a district of a region or a city of regional significance (except for the city that is the administrative center of the region);

2) a non-managerial position of the executive body of the district of the region and the city of regional significance (except for the city that is the administrative center of the region), funded from the local budget;

3) not a senior position in the office of the akim of a city of regional significance, village, settlement, rural district;

4) a non-managerial position of a territorial subdivision of a central state body and its department in a district of a region or a city of regional significance (except for the city that is the administrative center of the region).

7. It is allowed to occupy administrative positions of building "B" without holding a competition in coordination with the authorized body.:

1) the head of an independent structural subdivision of a central government agency;

2) the head of the territorial subdivision of the central state body and its department in the region, the city of republican significance, the capital;

3) the head of the executive body of the region, the city of republican significance, the capital, financed from the regional budget, the budgets of the city of republican significance, the capital;

4) deputy head of the department of the central state body;

Note.

In this article, international employees are citizens of the Republic of Kazakhstan who are not civil servants, who carry out activities in international organizations and are recognized as international employees in accordance with international treaties ratified by the Republic of Kazakhstan.
