Article 15. The competence of the authorized body in the field of state aviation in the field of the use of airspace and aviation activities The Law on the Use of the Airspace of the Republic of Kazakhstan and Aviation Activities

The authorized body in the field of state aviation within its competence:

1) carries out state regulation and state control and supervision of the use of airspace and the activities of state aviation;

2) formulates and implements state policy in the field of the use of airspace and the activities of state aviation;

3) takes measures to repel an air attack or prevent and (or) stop violations of the State Border of the Republic of Kazakhstan in the airspace, as well as to eliminate the use of force or threat of use of force against the sovereignty, territorial integrity and security of the Republic of Kazakhstan;

4) prevents violations of the procedure for using the airspace of the Republic of Kazakhstan;

5) in coordination with the State Security Service of the Republic of Kazakhstan, with the national security authorities, develops and approves a list of restricted areas and flight restriction zones.;

6) establishes regimes and short-term restrictions on the use of airspace in accordance with the Rules for the Use of the Airspace of the Republic of Kazakhstan;

7) after coordination with the State Security Service of the Republic of Kazakhstan and with the national security authorities, issues special permits for overflight over the territory of restricted areas and restricted flight zones;

8) issues permits for international flights by aircraft of foreign states outside specially designated corridors crossing the State border of the Republic of Kazakhstan in the airspace;

9) approves permits for international flights by aircraft of the state aviation of foreign states;

10) keeps records of violations of the procedure for using the airspace of the Republic of Kazakhstan;

11) approves the Rules of flight operations of the State aviation of the Republic of Kazakhstan;

11-1) develops and approves Instructions on the organization of flight operations in the State aviation of the Republic of Kazakhstan;

12) approves the Instructions for the Prevention of Accidents in State Aviation;

13) approves the Rules of Engineering and aviation support of the State aviation of the Republic of Kazakhstan;

14) approves the Rules of navigation support for the State aviation of the Republic of Kazakhstan;

15) approves the Instructions for the application of state, registration and additional identification marks on aircraft of the state aviation of the Republic of Kazakhstan;

16) approves the standards of serviceability of airfields (heliports), airfield sections of highways and tactical and technical requirements for airfields of the state aviation of the Republic of Kazakhstan;

17) approves the Rules of operation of airfields (heliports) of the State aviation of the Republic of Kazakhstan;

18) approves the Rules for the State Registration of airfields (heliports) of State aviation;

19) issues an opinion on the suitability for use of airfields (heliports) of state aviation;

20) keeps records of violations of the safety requirements of state aviation, classifies aviation accidents and incidents, and monitors the activities of government agencies investigating aviation accidents and incidents in the field of state aviation;

21) organizes and conducts flight safety management activities;

22) excluded by the Law of the Republic of Kazakhstan dated 04/19/2019 No. 249-VI (effective after ten calendar days after the date of its first official publication); 23) excluded by the Law of the Republic of Kazakhstan dated 04/19/2019 No. 249-VI (effective after ten calendar days after the date of its first official publication);

23-1) develops and approves Instructions on the organization of objective flight control of the state aviation of the Republic of Kazakhstan;

23-2) develops and approves the Instruction on assignment (confirmation and reduction) of class qualifications of aviation personnel of the State aviation of the Republic of Kazakhstan;

24) approves the Instructions for the Aviation Search and Rescue Service of the State Aviation of the Republic of Kazakhstan;

25) approves the Rules of medical support for flights of the State aviation of the Republic of Kazakhstan;

26) approves the Rules of meteorological support for flights of the State aviation of the Republic of Kazakhstan;

27) approves the Rules of ornithological support of flights of the State aviation of the Republic of Kazakhstan;

28) approves the Rules for registration of aircraft of the State aviation of the Republic of Kazakhstan;

28-1) develops and approves the Operating Instructions for automotive and electric gas equipment at airfields (heliports) of the state aviation;

28-2) develops and approves Instructions on the organization of the movement of vehicles, ground support facilities for flights and pedestrians at airfields (heliports) of state aviation;

28-3) develops and approves the operating time (service life) standards for aerodrome and technical support of state aviation flights;

28-4) develops and approves Instructions on the joint use of airfields (heliports), landing sites, and flight support and control facilities for State aviation;

28-5) develops and approves Instructions for the organization of quality assurance of aviation fuels and lubricants and special liquids in state aviation;

28-6) develops and approves Rules for the organization of air transportation in State aviation;

29) approves the Instruction on Air Traffic Control;

29-1) issues permits provided for by the Law of the Republic of Kazakhstan "On Permits and Notifications", subject to the exceptions provided for in subparagraph 7) of paragraph 2 of Article 3 of the Law of the Republic of Kazakhstan "On Permits and Notifications";

30) exercise other powers provided for by this Law, other laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan.

The Law of the Republic of Kazakhstan dated July 15, 2010 No. 339-IV.

This Law regulates public relations related to the use of the airspace of the Republic of Kazakhstan and aviation activities, and defines the procedure for the use of airspace and aviation activities in order to protect human life and health, the environment, the interests of the state, ensure the safety of aircraft flights and meet the needs of the economy of the Republic of Kazakhstan, individuals and legal entities in aviation services.
