Article 16. Additional measures and time restrictions applied in a state of emergency The Law On the State of Emergency

      1. In the event of a state of emergency, in the presence of the circumstances provided for in subparagraph 1) of paragraph 2 of Article 4 of this Law, the following additional measures and time restrictions are provided for in the area where the state of emergency is being introduced:

     1) introduction of a curfew;

     1-1) the use of territorial troops of the Armed Forces of the Republic of Kazakhstan;

     2) exercising control over the mass media by requesting mandatory copies of printed publications and materials from radio and television programs;

     3) suspension or termination of the activities of political parties and public associations in accordance with the procedure established by the legislation of the Republic of Kazakhstan, which prevent the elimination of circumstances that served as the basis for the introduction of a state of emergency;

     4) restriction or prohibition of the use of copying and multiplying equipment, radio and television transmission equipment, audio and video recording equipment, as well as the temporary withdrawal of sound-amplifying equipment;

     5) the establishment of a special procedure for the sale, purchase and distribution of food and basic necessities;

     6) the establishment of restrictions on the implementation of certain types of financial and economic activities of individuals and legal entities, including the movement of goods, services and financial resources;

     7) restriction or prohibition of the sale of weapons, ammunition, explosives, special equipment, toxic substances, establishment of a special regime for the turnover of medicines, narcotic drugs, psychotropic substances, precursors, as well as ethyl alcohol, alcoholic products;

     8) temporary seizure of weapons and ammunition, toxic substances from individuals, and from legal entities, with the exception of those subordinate to state bodies, special state and law enforcement agencies, and the Ministry of Defense of the Republic of Kazakhstan, temporary seizure, along with weapons, ammunition, and toxic substances, of combat and training military equipment, explosives, and radioactive substances.

     Additional measures and temporary restrictions applied in a state of emergency are implemented in accordance with the procedure determined by the Government of the Republic of Kazakhstan.

     2. In the event of a state of emergency, in the presence of the circumstances provided for in subparagraph 2) of paragraph 2 of Article 4 of this Law, the following additional measures and time restrictions are provided for in the area where the state of emergency is being introduced:

     1) temporary relocation of residents to safe areas with mandatory provision of temporary living quarters;

     1-2) carrying out measures to strengthen the protection of the State Border of the Republic of Kazakhstan and checkpoints across the State border of the Republic of Kazakhstan;

     2) introduction of quarantine, carrying out sanitary, anti-epidemic and anti-epizootic measures;

     3) using the state material reserve in accordance with the procedure established by the legislation of the Republic of Kazakhstan, attracting the resources of legal entities, changing their working hours and reorienting to the production of products necessary in a state of emergency;

      4) in cases related to the need to carry out and provide emergency rescue and other urgent work, the involvement of the able-bodied population and vehicles of individuals to carry out these works with mandatory compliance with the requirements of the labor legislation of the Republic of Kazakhstan.  

     3. In the event of the introduction of a state of emergency, in the presence of the circumstances provided for in subparagraph 2) of paragraph 2 of Article 4 of this Law, in the locality where the state of emergency is being introduced, in exceptional cases, in the absence or insufficiency of the state reserve of logistical, food, medical and other resources created to ensure guaranteed protection of the population, the environment and facilities management of natural and man-made emergencies, property is requisitioned in case of natural and man-made emergencies in accordance with the procedure provided for by the Law of the Republic of Kazakhstan "On State Property".

 

 

The Law of the Republic of Kazakhstan dated February 8, 2003 No. 387.

     This Law establishes the grounds, terms, procedure for the introduction and operation of a state of emergency throughout the territory of the Republic of Kazakhstan or in its individual localities, and the legal regime of a social emergency.
