Article 16. Competence of the authorized state body for labor in the field of regulation of labor relations of the Labor Code of the Republic of Kazakhstan

Article 16. Competence of the authorized state body for labor in the field of regulation of labor relations of the Labor Code of the Republic of Kazakhstan  

     Authorized State body for Labor:

     1) implements the state policy in the field of labor, safety and labor protection;

     1-1) formulates and implements the state policy in the field of labor, safety and labor protection;

     2) organizes state control over compliance with the labor legislation of the Republic of Kazakhstan, including the requirements for occupational safety and health, the legislation of the Republic of Kazakhstan on employment;

     3) provides methodological guidance and coordination of local executive bodies in the field of regulation of labor relations;

     4) requests the necessary information from local labor inspection authorities on labor relations issues; - Excluded by the Law of the Republic of Kazakhstan.

     5) excluded by the Law of the Republic of Kazakhstan dated 26.11.2019 No. 273-VI (effective ten calendar days after the date of its first official publication);  

     6) coordinates the activities of government agencies on the development of technical regulations in the field of occupational safety and health;

     7) carries out coordination and interaction in the field of occupational safety and health with other government agencies, as well as with representatives of employees and employers;

      8) establishes the procedure for the development, approval, replacement and revision of labor standards by the employer, standard labor standards and standards, uniform and (or) intersectoral, standard labor standards and standards for all fields of activity;  

     9) develops and approves a list of employee job titles related to administrative staff;

     9-1) determines the amount of social benefits for temporary disability;

     10) establishes the procedure for the presentation, consideration and coordination of labor standards in organizations for services (goods, works) of which state regulation of tariffs (prices, rates of fees) is introduced;

     11) establishes the procedure for submitting, reviewing and approving parameters for the remuneration system of employees of organizations for services (goods, works) of which state regulation of tariffs (prices, rates of fees) is introduced;

     12) carries out registration of industry agreements;

     13) conducts training and certification of state labor inspectors;

     14) monitors the timely and objective investigation of labor-related accidents in accordance with the procedure established by this Code and other regulatory legal acts of the Republic of Kazakhstan.;

     15) carries out international cooperation in the field of regulation of labor relations;

     Note from <url>!       Subparagraph 16) is provided to be deleted by the Law of the Republic of Kazakhstan dated 07/04/2023 No. 15-VIII (effective from 01/01/2030).        16) determines the procedure for the development, revision, approval and application of the Unified Tariff and Qualification Directory of Workers' jobs and Professions, tariff and qualification characteristics of workers' professions, Qualification Directory of positions of managers, specialists and other employees, as well as standard qualification characteristics of positions of managers, specialists and other employees of organizations;

     Note from <url>!       Subparagraph 16-2) is provided to be deleted by the Law of the Republic of Kazakhstan dated 07/04/2023 No. 15-VIII (effective from 01/01/2030).        16-2) develops and approves the qualification characteristics of individual positions of specialists in government institutions and state-owned enterprises, common to all fields of activity;

     Note from <url>!       Subparagraph 17) is provided to be deleted by the Law of the Republic of Kazakhstan dated 07/04/2023 No. 15-VIII (effective from 01/01/2030).        17) reviews and coordinates qualification reference books or standard qualification characteristics of positions of managers, specialists and other employees of organizations of various types of economic activity, developed and approved by authorized state bodies of the relevant fields of activity;

     18) determines the list of industries, workshops, professions and positions, the list of heavy work, work with harmful and (or) dangerous working conditions, work in which entitles to reduced working hours, additional paid annual leave and increased wages, as well as the procedure for their provision (hereinafter – the List of industries, workshops, professions and positions, a list of heavy work, work with harmful and (or) dangerous working conditions);

     19) establish a commission to investigate group accidents in accordance with this Code and other regulatory legal acts of the Republic of Kazakhstan;

     20) organizes monitoring and assessment of risks in the field of occupational safety and health;

      21) approves the model regulation on labor arbitration;  

     22) establishes a uniform procedure for calculating the average salary;

     23) determines the procedure for entering the civil service and holding a competition for the vacant position of a civil servant, with the exception of the first head and teacher of a state educational organization, as well as the first head of a state physical culture and sports organization;

     24) defines the general requirements for professional training, retraining and advanced training of personnel in the organization;

     25) approves the form, procedure for maintaining and storing workbooks;

     26) approves the list of jobs where the use of labor by employees under the age of eighteen is prohibited, as well as the maximum standards for carrying and moving heavy loads by employees under the age of eighteen;

     27) approves the maximum standards for lifting and moving weights manually by women;

     28) approves the standard regulations on the occupational safety and health service in the organization;

     29) determines the procedure for mandatory periodic certification of production facilities according to working conditions;

     30) develops and approves rules and deadlines for conducting training, instruction and knowledge testing on occupational safety and health issues for employees, managers and persons responsible for ensuring occupational safety and health;

     31) establishes the procedure for the development, approval and revision of instructions on occupational safety and health by the employer;

      32) determines the procedure for the appointment and payment of social benefits for temporary disability;  

     33) approves the procedure for providing employees with milk or equivalent foodstuffs and (or) specialized products for dietary (therapeutic and preventive) nutrition, special clothing and other personal protective equipment, and also establishes the procedure for providing them with collective protective equipment, sanitary facilities and devices at the expense of the employer;

     34) approves, in coordination with the central authorized body for budget planning, the norms for the provision of milk or equivalent food products and (or) specialized products for dietary (therapeutic and preventive) nutrition to employees.;

      35) approves, in coordination with the central authorized body for budget planning, the standards for the issuance of special clothing and other personal protective equipment to employees of organizations of various types of economic activity.;  

     36) develops and approves the procedure for declaring the employer's activities;

     37) determines the priorities of scientific research in the field of occupational safety and health and regulation of labor relations;

     38) organizes the development of scientific, scientific and technical projects and programs funded from the state budget, and implements them;

     39) develops and approves the form of accounting for collective labor disputes;

     40) develops and approves uniform intersectoral standards for the number of employees providing maintenance and functioning of government agencies;

     40-1) coordinates industry standards for the number of employees providing maintenance and functioning of state bodies, developed and approved by state bodies of the relevant fields of activity in accordance with the procedure established by the authorized state body for labor;

     41) coordinate the registers of civil servants' positions developed and approved by the relevant authorized state bodies of the relevant fields of activity;

     41-1) develops and approves a model regulation on the occupational health and safety management system;

     41-2) develops and approves professional risk management rules;  

     41-3) develops and approves cross-industry standard standards for the number of employees of labor protection services;

     41-4) develops and approves the Code of Professional Ethics for Civil Servants;

     41-5) develops and approves rules for the submission and receipt of information about an employment contract in the unified system of accounting for employment contracts;

     41-6) develops and approves the rules for the design and application of work permits in high-risk environments;

     41-7) ensures the confidentiality and protection of the employee's personal data contained in the unified accounting system of employment contracts, in accordance with the legislation of the Republic of Kazakhstan on personal data and their protection;

41-8) provides information from the unified accounting system for employment contracts to individuals and legal entities, taking into account the requirements of the legislation of the Republic of Kazakhstan on personal data and their protection; - Excluded by the Law of the Republic of Kazakhstan.

     41-9) develops and approves rules for ensuring occupational safety and health at work at height;

     42) exercise other powers provided for by this Code, the laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan.
