Article 16. Radioactive Waste Producers of the Law On Radioactive Waste Management

     1. The producers of radioactive waste are obliged to:

     1) to assess the possibility of further use of materials, substances, equipment and products containing radionuclides, and if it is impossible to continue using them, to classify such materials as radioactive waste in accordance with the criteria for classification as radioactive waste.;

     2) ensure the safe handling of radioactive waste before it is transferred to the national operator for disposal;

     3) ensure that radioactive waste is brought into a condition acceptable for disposal in accordance with the acceptance criteria approved by the authorized body;

     4) finance the work on radioactive waste management, as well as on their transfer to the national operator for burial;

     5) transfer radioactive waste to the national operator with the provision of complete information necessary for their identification, accounting and confirmation of compliance with the acceptance criteria.

     2. Radioactive waste producers are responsible for ensuring the safe handling of radioactive waste before its transfer to the national operator.

     3. Upon termination of their activities, the radioactive waste producers are obliged to:

     1) notify the authorized body of the intention to terminate the activity;

     2) transfer all available radioactive waste to storage and (or) burial sites in accordance with the procedure established by the legislation of the Republic of Kazakhstan in the field of radioactive waste management;

     3) carry out work on decontamination of equipment, buildings, structures and communications, reclamation of the territory and restoration of the environment.
