Article 17. National Radioactive Waste Management Operator of the Law on Radioactive Waste Management
1. The national operator has the exclusive right to:
1) carrying out activities related to all stages of the life cycle of burial sites and performing burial work on the territory of the Republic of Kazakhstan, except for the cases provided for by the Law of the Republic of Kazakhstan "On the Semipalatinsk Nuclear Safety Zone" and this Law;
2) carrying out work on the elimination and (or) conservation of nuclear heritage facilities owned by the state or subject to transfer to state ownership in accordance with the procedure established by the legislation of the Republic of Kazakhstan;
3) performing work to eliminate the consequences of uranium mining and processing, as well as the conservation of facilities and structures contaminated with radioactive materials as a result of such activities, in cases provided for by the Code of the Republic of Kazakhstan "On Subsoil and Subsoil Use", this Law and other laws of the Republic of Kazakhstan.
2. When performing the works specified in subitems 2) and 3) of paragraph 1 of this article, reclamation measures are carried out aimed at restoring the environment, reducing radiation risks and ensuring radiation safety of the population and territories, according to the project documentation.
3. The National Operator performs the following functions:
1) ensures safe handling of radioactive waste accepted for storage and (or) burial;
2) determines the compliance of the radioactive waste transferred to it for storage and (or) burial with the declared data and acceptance criteria;
3) ensures the safe operation of radioactive waste management facilities under its jurisdiction;
4) carries out the operation, maintenance, reconstruction, closure and post-operational monitoring of burial sites under its jurisdiction;
5) develops and implements programs to ensure the quality of radioactive waste management within its activities;
6) submits proposals to the authorized body for the development of infrastructure for the management of radioactive waste;
7) conducts research and development work related to the safety of the placement and operation of radioactive waste management facilities;
8) accepts radioactive waste for storage and (or) burial on a reimbursable basis in accordance with the procedure established by the legislation of the Republic of Kazakhstan;
9) provides radiation control and monitoring of the location of burial sites;
10) ensures that government agencies and the public are informed about the radiation situation in the territories of burial sites under its jurisdiction, in accordance with the procedure established by the legislation of the Republic of Kazakhstan;
11) carries out work to eliminate the consequences of the activities of nuclear heritage sites, including reclamation measures aimed at restoring the environment and ensuring radiation safety of the population and territories;
12) carries out other types of activities in accordance with the legislation of the Republic of Kazakhstan.
4. The national operator has the right to:
1) to request and receive information from radioactive waste collectors and organizations performing work in the field of radioactive waste management to the extent necessary and sufficient to perform the functions assigned to it.;
2) submit proposals to the authorized body on improving regulatory legal acts on safety in the field of radioactive waste management;
3) conclude contracts for the performance of works and the provision of services for the management of radioactive waste within their competence;
4) refuse to accept radioactive waste for burial if it is found that it does not meet the acceptance criteria.;
5) involve specialized organizations with appropriate licenses in the field of atomic energy use in the performance of certain works.;
6) exercise other rights necessary to achieve the main goals and objectives established by this Law, in accordance with the legislation of the Republic of Kazakhstan.
