Article 19. The procedure for considering candidates for vacant positions of chairmen of district courts, chairmen of regional courts, chairmen of Cassation courts, chairmen of judicial boards of the Supreme Court of the Law on the Supreme Judicial Council of the Republic of Kazakhstan
1. Candidates for vacant positions of chairmen of regional courts, chairmen of cassation courts, and chairmen of judicial boards of the Supreme Court are considered by the Council on an alternative basis upon the proposal of the Chairman of the Supreme Court, submitted by him after their consideration by the plenary session of the Supreme Court.
1-1. Candidates for vacant positions of district court chairmen are considered by the Council from among the persons elected by the expanded plenary session of the regional court and who have received an appropriate opinion.
2. Candidates for the positions of chairmen of district courts must be current judges or have at least five years of judicial experience.
Candidates for vacant positions of chairmen of regional courts are recommended, as a rule, from among the judges of the regional court or persons with at least ten years of judicial experience.
Candidates for vacant positions of chairmen of the cassation courts are recommended, as a rule, from among the judges of the cassation court or persons with at least ten years of judicial experience.
Candidates for the positions of chairmen of judicial boards of the Supreme Court are submitted from among the judges of the Supreme Court.

3. The materials for all candidates considered at the plenary session of the relevant court on an alternative basis are attached to the submission of the Chairman of the Supreme Court.
3-1. The decision to declare a vacancy for the position of chairman of the district court is made by the Chairman of the Council on the proposal of the Secretary of the Council, taking into account the terms of office of the chairmen of the district courts.
A vacancy announcement is published on the Council's Internet resource within the time limits set by the Council's regulations.
3-2. The Council checks candidates who have independently nominated themselves for the vacant position of chairman of the district court for compliance with the requirements established by the legislation of the Republic of Kazakhstan.
The procedure for conducting such an audit is determined by the regulations of the Council.
3-3. The procedure for the Council to nominate candidates for the expanded plenary session of the regional court from among the persons in the personnel reserve and (or) persons who independently nominated their candidacy, the procedure for the selection of candidates elected by the expanded plenary session of the regional court for the position of chairman of the district court, as well as the procedure for reviewing the recommendations of the Council in cases of refusal of the candidate from appointment to the position They are determined by the regulations of the Council.
3-4. If a candidate refuses to be appointed to the position of chairman of the district court, the recommendation of the Council on appointment to a vacant judicial position in respect of such candidate is canceled and:
1) the vacant position of the chairman of the district court may be offered to other candidates elected by the extended plenary session.;
2) A repeat selection may be announced.
4. The Council necessarily considers at the meeting all the elected or submitted candidates for vacant positions of chairmen of district courts, chairmen of regional courts, chairmen of cassation courts, chairmen of judicial boards of the Supreme Court.
