Article 2. Competence of authorized state bodies of the Code on Customs Regulation in the Republic of Kazakhstan

Article 2. Competence of authorized state bodies of the Code on Customs Regulation in the Republic of Kazakhstan

     1. The authorized body in the field of customs policy in accordance with the customs legislation of the Eurasian Economic Union and (or) the legislation of the Republic of Kazakhstan:

     1) develops proposals for the formation of customs policy in the Republic of Kazakhstan;

     2) develops and approves the normative legal acts provided for by this Code within the limits of its competence;

     3) exercise other powers provided for by this Code, other laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan.

     2. The authorized body in the field of customs affairs (hereinafter referred to as the authorized body) in accordance with the customs legislation of the Eurasian Economic Union and (or) the legislation of the Republic of Kazakhstan:

     1) develops and approves the normative legal acts provided for by this Code, within the limits of its competence;

     2) manages the customs authorities of the Republic of Kazakhstan;

     3) defines the powers of the department that is part of it;

     3-1) develops and approves the rules for conducting expert examinations not provided for in Chapter 54 of this Code in order to solve the tasks assigned to the authorized body;

     4) develops and approves rules for the establishment, categorization, classification, as well as rules of procedure and standard requirements for the arrangement and logistical equipment of customs offices, customs posts and checkpoints in the part not regulated by the customs legislation of the Eurasian Economic Union;

     5) creates information systems, communication systems and data transmission systems, technical means of customs control, as well as information security means;

     6) decides on the inclusion of persons in the registers of persons engaged in activities in the field of customs affairs, as well as in the register of authorized economic operators;

     7) carries out customs administration;

     8) carries out customs control over the movement of goods and vehicles across the customs border of the Eurasian Economic Union;

     9) ensures timely informing of participants in foreign economic and other activities in the field of customs affairs on an ongoing basis, including on amendments and additions to the customs legislation of the Eurasian Economic Union and (or) the Republic of Kazakhstan;

     10) maintains customs statistics;

     11) develops and approves instructions for performing certain customs operations;

     12) develops and approves instructions on the application of certain forms of customs control and measures to ensure customs control;

     13) participates in the development of legal acts in the field of control of specific goods;

     14) develops and approves the procedure for the creation, operation, and equipping, including with vehicles, of mobile groups in customs authorities;

 15) exercise other powers provided for by this Code, other laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan.
