1. The right of subsurface use arises on the basis of:

1) subsurface use licenses;

2) the contract for subsurface use.

2. The right of subsurface use is acquired in the following cases::

1) granting the right of subsurface use;

2) transfer of the right of subsurface use (share in the right of subsurface use) on the basis of civil law transactions;

3) transfer of the right of subsurface use by way of succession during the reorganization of a legal entity, with the exception of transformation or inheritance.
