Article 219. Illegal obtaining of a loan or misuse of a budget loan The Criminal Code of the Republic of Kazakhstan, the Criminal Code of the Republic of Kazakhstan - Excluded by the Law of the Republic of Kazakhstan.
1 Receipt by an individual entrepreneur or the head of an organization of a loan, subsidies or preferential credit conditions by knowingly providing false information to a bank or other lender about the economic situation, financial condition or collateral of an individual entrepreneur or organization, or about other circumstances essential for obtaining a loan, subsidies, preferential credit conditions, as well as failure to inform the bank or other lender information to another lender about the occurrence of circumstances that may lead to the termination of lending, subsidizing, cancellation of benefits or limitation of the amount of allocated loans or subsidies, if these acts have caused major damage., –
are punishable by a fine in the amount of up to two thousand monthly calculation indices, or correctional labor in the same amount, or community service for up to six hundred hours, or restriction of liberty for up to two years, or imprisonment for the same term.
2 The misuse of a budget loan for its intended purpose, if this act has caused major damage to a citizen, organization or the state., –
is punishable by a fine in the amount of up to two thousand monthly calculation indices, or correctional labor in the same amount, or community service for up to six hundred hours, or restriction of liberty for up to two years, or imprisonment for the same term.
Note. A person who has committed an act provided for in this article for the first time shall be released from criminal liability in case of voluntary compensation for damage.
