Article 22. Basic rights and duties of an employee of the Labor Code of the Republic of Kazakhstan

Article 22. Basic rights and duties of an employee of the Labor Code of the Republic of Kazakhstan  

     1. An employee has the right to:

     1) conclusion, amendment, addition, termination of an employment contract in accordance with the procedure and on the terms provided for by this Code;  

     2) the requirement from the employer to fulfill the terms of employment, collective agreements, agreements, acts of the employer;

     3) Occupational safety and health;

     4) obtaining complete and reliable information on the state of working conditions and occupational safety;

     5) timely and full payment of wages in accordance with the terms of labor and collective agreements;

     6) payment for downtime in accordance with this Code;

     7) rest, including paid annual work leave;

     8) an association, including the right to form a trade union, as well as membership in it, to represent and protect their labor rights and interests, unless otherwise provided by the laws of the Republic of Kazakhstan;

     9) participation through their representatives in collective negotiations and the development of a draft collective agreement, as well as familiarization with the signed collective agreement;

     10) compensation for damage caused to health in connection with the performance of labor (official) duties;

     11) compulsory social insurance;

     12) insurance against accidents in the performance of labor (official) duties;

      13) guarantees and compensation payments;  

     14) protection of their rights and legitimate interests in all ways that do not contradict the law;

     15) equal pay for equal work, as well as equal working and living conditions without any discrimination;

     16) applying for consideration of an individual labor dispute sequentially to a conciliation commission or court in accordance with the procedure provided for by this Code;

     17) a workplace equipped in accordance with the requirements of occupational safety and health;

     18) provision of means of individual and collective protection, special clothing in accordance with the requirements stipulated by the legislation of the Republic of Kazakhstan, as well as labor and collective agreements;

     19) refusal to perform work in the event of a situation that poses a threat to his health or life, with notification of his immediate supervisor or representative of the employer.;

     20) an application to the authorized state body for labor and (or) to a territorial subdivision for conducting a survey of occupational safety and health conditions at the workplace, as well as for representative participation in the inspection and consideration of issues related to improving working conditions, safety and health;

     21) appeal against the actions (inaction) of the employer in the field of labor and directly related relations;

     22) remuneration in accordance with qualifications, complexity of work, quantity and quality of work performed, as well as working conditions;

      23) resolution of individual and collective labor disputes, including the right to strike, in accordance with the procedure established by this Code and other laws of the Republic of Kazakhstan;  

     24) ensuring the protection of personal data stored by the employer;

     25) obtaining information about the employment contract and their work activities from the unified accounting system for employment contracts.

     26) conclusion of an agreement on non-disclosure of information on assistance in combating corruption in accordance with the procedure established by the legislation of the Republic of Kazakhstan on combating corruption.

     2. The employee is obliged to:

     1) perform labor duties in accordance with agreements, labor, collective agreements, acts of the employer;

     2) observe labor discipline;

     3) comply with the requirements for occupational safety and health, fire safety, industrial safety and industrial sanitation at the workplace;

     4) take good care of the property of the employer and employees;

     5) inform the employer about a situation that poses a threat to the life and health of people, the safety of the employer's and employees' property, as well as the occurrence of downtime;

     6) not to disclose information that constitutes state secrets, official, commercial or other legally protected secrets that have become known to him in connection with the performance of his work duties;

     7) compensate the employer for the damage caused within the limits established by this Code and other laws of the Republic of Kazakhstan.

    8) notify the employer in writing within three working days of the conclusion of a contract for military service in the reserve.

  9) inform the employer about his involvement as a volunteer firefighter to carry out measures to prevent and extinguish steppe fires, as well as fires in organizations and settlements.

     3. An employee has other rights and performs other duties stipulated by this Code.
