Article 224. Refusal to assign retention status The Code on Subsoil and Subsoil Use Republic of Kazakhstan

Article 224. Refusal to assign retention status The Code on Subsoil and Subsoil Use Republic of Kazakhstan  

     1. The competent authority refuses to assign a retention status to a mining site (part of it) under a license for the extraction of solid minerals if there are one of the following grounds::

     1) the application or the documents attached to it do not comply with the requirements provided for in this Code;

     2) the documents required by this Code are not attached to the application.;

     3) failure by the applicant to comply with the deadline for submitting to the competent authority a conservation project developed in accordance with the procedure provided for in Article 223 of this Code;

     4) the justifications provided by the subsurface user and the documents submitted are insufficient to confirm the existence of circumstances that are the basis for assigning a mining site (part of it) retention status.

     2. Refusal to assign a mining site (part of it) The retention status is issued in writing, must be motivated and issued to the applicant within the time period provided for granting the retention status.

     3. The competent authority shall notify the applicant of the refusal to assign a mining site (part of it). retention status within two business days from the date of the decision to refuse.

     4. Refusal to assign a mining site (part of it) the status of retention may be appealed by the applicant in accordance with the legislation of the Republic of Kazakhstan no later than ten working days from the date of notification of the applicant's refusal.

     5. Refusal to assign a mining site (part of it) The retention status does not deprive the applicant of the right to resubmit the application.
