Article 23-1. Technical cover of the communication routes of the Law on Transport in the Republic of Kazakhstan
1. The technical cover of the communication routes is carried out in accordance with the procedure determined by the Government of the Republic of Kazakhstan.
2. In order to eliminate situations threatening the national security of the Republic of Kazakhstan, state bodies, within the limits of their competence established by the legislation of the Republic of Kazakhstan, adopt regulatory legal acts on technical cover of communication routes.
3. Within the limits of their competence, state bodies or persons who own, by right of ownership or on other legal grounds, the transport infrastructure facilities specified in paragraph 5 of this article are obliged to plan, provide and carry out technical cover of communication routes. At the same time, financing of the technical cover of communication routes is carried out in accordance with the procedure determined by the legislation of the Republic of Kazakhstan in the field of mobilization training and mobilization, to finance mobilization training, mobilization bodies and mobilization.
4. The authorized state body, together with the authorized body for architecture, urban planning and construction, ensures the accumulation of technical, design documentation, supporting materials and materials necessary for the construction and restoration of transport infrastructure facilities in peacetime and in wartime.
5. Main roads, highways of international, national and regional significance, bridges and tunnels located on them, railway junctions, ports, hydraulic engineering and water management structures used for navigation, and locks located on inland waterways, airfields, and the main pipeline are subject to technical cover.
Note:
1) technical cover is understood as a set of special measures carried out in peacetime and in wartime on communication routes in order to ensure functioning and rapid recovery after destruction.;
2) communication routes are understood as routes (highways, railways and waterways, air routes), structures and devices on them that ensure the reception and departure of vehicles (aircraft), the movement of people and goods between points of departure and destination;
3) railway junctions are understood as the point of intersection of several railway lines, which is a complex of technical structures and devices for marshalling, freight and passenger stations, connecting tracks between stations, bypass tracks, station facilities for passengers, depots, technical stations for the repair and equipping of railway personnel.
The Law of the Republic of Kazakhstan dated September 21, 1994 No. 156.
This Law defines the foundations of the legal, economic and organizational activities of transport in the Republic of Kazakhstan.
