Article 23-1. The procedure for appointment of officials of the Republic by the Chambers of Parliament of the Constitutional Law on the Parliament of the Republic of Kazakhstan and the Status of its Deputies
1. Each of the Chambers of Parliament independently appoints three judges of the Constitutional Court without the participation of the other Chamber; appoints two members of the Central Election Commission and three members of the Supreme Audit Chamber for a five-year term.
2. The appointment of the persons referred to in paragraph 1 of this article shall be carried out at a meeting of the Chamber. The proposed candidates for appointment by the Chamber to the positions of the persons specified in paragraph 1 of this article, prior to consideration of the issue at a meeting of the Chamber, are subject to discussion at a meeting of the relevant committee of the Chamber, determined by a decision of the Bureau of the Chamber. Based on the results of consideration of candidates, the committee issues an opinion on each candidate under discussion, which is announced at a meeting of the Chamber.
3. When considering the issue of appointment to a position at a meeting of the relevant Chamber, candidates for positions are presented by the Chairman of the relevant Chamber.
4. At a meeting of the relevant Chamber, there may be:
1) questions were asked to the candidate and the person representing the candidate;
2) the opinions of the deputies were expressed "for" or "against" the proposed candidate.
5. The debate on the proposed candidate may not be opened unless the deputies insist on it.
6. If the relevant Chamber of Parliament has not taken decisions on the proposed candidates for appointment, the Chairman submits written submissions to the relevant Chamber for the same persons or for new candidates.
7. The Mazhilis and the Senate of Parliament shall adopt decisions on the appointment of persons specified in paragraph 1 of this Article by a majority vote of the total number of deputies of the relevant Chamber of Parliament.
8. Decisions are taken separately on each candidate by open voting, unless the relevant Chamber determines a different voting procedure.
9. Decisions are drawn up by resolutions of the relevant Chamber separately for each candidate.
10. In case of rejection of candidates submitted by the Chairman of the Chamber for appointment, the decision of the relevant Chamber must contain detailed reasons for the rejection.
