Article 235. Failure to comply with the requirement of repatriation of national and (or) foreign currency of the Criminal Code of the Republic of Kazakhstan, the Criminal Code of the Republic of Kazakhstan

     Failure to comply with the requirement to repatriate national and (or) foreign currency by non-return from abroad by a person performing managerial functions in a commercial or other organization or an individual entrepreneur of funds in national and (or) foreign currency in large amounts, subject to mandatory crediting in accordance with the currency legislation of the Republic of Kazakhstan, to a bank account –

     is punishable by a fine in the amount of up to five thousand monthly calculation indices, or correctional labor in the same amount, or community service for up to one thousand two hundred hours, or restriction of liberty for up to five years, or imprisonment for the same term.

     Note. A person who has committed an act provided for in this article for the first time shall be released from criminal liability in the event of a return to a bank account of funds subject to mandatory crediting in accordance with the currency legislation of the Republic of Kazakhstan.
