Article 24. Terms of military service. Length of service The Law on Military Service and the Status of Military Personnel

    1. The terms of military service in calendar terms are established:

     1) for conscripts – twelve months;

     2) for conscripted military officers – twenty-four months;

     3) for military personnel undergoing military service under a contract – for the terms specified in the contract on military service.;

     4) for military reservists – for periods of being in classes or training camps for combat training, crisis training camps.

     2. The length of service is calculated in accordance with the procedure established by the legislation of the Republic of Kazakhstan in order to calculate the duration of military service, which entitles to a pension. Military service is calculated in accordance with the procedure determined by the Government of the Republic of Kazakhstan.

     The time of military service not in military positions is counted in the length of service. The length of service is counted in the total length of service and in the length of public service.

     For military personnel who have left abroad in connection with further military service (admission to study) of the spouse of a serviceman (spouse of a serviceman), the time spent abroad is counted in the length of service.

     Prior to entering military service in the Armed Forces, other troops and military formations who served in law enforcement and special state bodies, civil protection bodies, the length of service is calculated taking into account the time they worked in law enforcement and special state bodies, civil protection bodies in positions providing for the assignment of military or special ranks, class ranks.

     The length of public service, including law enforcement service, service in civil protection bodies, includes the time during which a civil servant, an employee of a law enforcement agency and a civil protection body were temporarily appointed to a military position in a state body, the structure of which provides for military service, as well as the time of their transfer from one state body. to another government agency.

     For persons who have entered the civil service, the time of military service and the period of appointment to a military position are counted in the length of public service.

     Military service is considered continuous if no more than three months have passed from the date of dismissal of a serviceman from military service, an employee from law enforcement and special state bodies, civil protection bodies, and the state courier service of the Republic of Kazakhstan until the day of his admission to military service, provided that he does not have an employment relationship with other natural and legal persons during the specified period. legal entities. At the same time, the specified period is not counted when calculating the length of service for determining the official salary and (or) length of service for assigning pension payments for years of service.

     This Law regulates public relations in the field of military service by citizens of the Republic of Kazakhstan and defines the foundations of the state policy on social security for military personnel.
