Article 25. Pre-trial settlement of complaints against decisions, acts of the Prosecutor's Office and actions (inaction) of officials of the Prosecutor's Office of the Constitutional Law on the Prosecutor's Office
1. A complaint against decisions, acts of the prosecutor's office or actions (inaction) of the prosecutor shall be filed with the prosecutor's office no later than three months from the date on which the person became aware of the decision, act or commission of an action (inaction), and considered by a higher prosecutor.
The complaint review period is twenty working days.
If, for a valid reason, the time limit for appeal is missed, the time limit may be restored by the prosecutor's office reviewing the complaint at the request of the person who filed the complaint, unless otherwise provided by the laws of the Republic of Kazakhstan.
2. The results of the pre-trial review of the complaint are the basis for appealing the decision, act and action (inaction) of the prosecutor to the court in accordance with the procedure provided for by the Administrative Procedural Code of the Republic of Kazakhstan.
3. The requirements of paragraph 1 of this Article do not apply to complaints, the procedure for consideration of which is established by the criminal procedure legislation of the Republic of Kazakhstan, the civil procedure legislation of the Republic of Kazakhstan, the penal enforcement legislation of the Republic of Kazakhstan, the legislation of the Republic of Kazakhstan on administrative offenses, the legislation of the Republic of Kazakhstan in the fields of counterintelligence and operational investigative activities.
4. The requirements of this article do not apply to complaints filed in accordance with the Law of the Republic of Kazakhstan "On the Return of Illegally Acquired Assets to the State".
