Article 250. Abuse of authority The Criminal Code of the Republic of Kazakhstan, the Criminal Code of the Republic of Kazakhstan
1 The use by a person performing managerial functions in a commercial or other organization of his powers contrary to the legitimate interests of this organization and in order to extract benefits and advantages for himself or other persons or organizations, or to harm other persons or organizations, if this has entailed causing significant harm to the rights and legitimate interests of citizens or organizations or the legally protected interests of society or states, –
is punishable by a fine in the amount of up to four thousand monthly calculation indices or correctional labor in the same amount, or community service for up to one thousand hours, or restriction of liberty for up to four years, or imprisonment for the same period, with or without confiscation of property, with deprivation of the right to hold certain positions. or engage in certain activities for up to five years.
2 The same acts committed by a senior employee of a financial institution, a banking and (or) insurance holding company, a major participant (major shareholder) – an individual, the head, a member of the governing body, the head, a member of the executive body, the chief accountant of a major participant (major shareholder) – a legal entity of a financial institution that caused major damage to a citizen, to a legal entity, state, or financial institution, –
are punishable by a fine in the amount of up to four thousand monthly calculation indices or correctional labor in the same amount, or community service for up to one thousand hours, or restriction of liberty for up to four years, or imprisonment for the same period, with or without confiscation of property, with deprivation of the right to hold certain positions or engage in certain activities for a period of five years until a ban is imposed on holding the position of a senior employee of a financial institution., be a major participant (major shareholder) of a financial institution for life in a banking and/or insurance holding company.
