Article 255. Personal search CPC RK Criminal Procedure Code of the Republic of Kazakhstan

  1. If there are grounds provided for in Article 252 and in compliance with the requirements of Article 254 of this Code, the person conducting the pre-trial investigation has the right to conduct a personal search in order to locate and seize objects and documents located on or inside the body of the person being searched, in his clothes and possessions.

     2. A personal search is carried out only by a person of the same sex as the person being searched and with the participation of witnesses and, if necessary, specialists of the same sex.

     3. A personal search may be carried out without a special order and the approval of the investigating judge in the presence of one of the following cases::

     1) if there are sufficient grounds to believe that a person who is in a room or other place where a search is being carried out in compliance with the requirements of Article 254 of this Code is hiding documents or items that may be relevant to the case.;

     2) if it is carried out during the detention of a person or his detention. In this case, a personal search may be carried out in the absence of witnesses.

     If it is necessary to find objects inside the body of the person being searched, specialists of the appropriate profile participate in a personal search.
