1. Individuals engaged in the provision of services or the performance of work using Internet platforms and (or) mobile applications for platform employment, individual entrepreneurs or legal entities, before starting their activities as a taxi carrier, are required to send a notice of commencement of activities to the local executive body in accordance with the procedure established by the Law of the Republic of Kazakhstan "On Permits and Notifications".

2. Taxi carriers are required to:

1) to use taxis for the transportation of passengers and luggage that have a single color scheme and distinctive designations in accordance with the Rules for the Transportation of Passengers and Luggage by Road, with the exception of transportation by individuals engaged in the provision of services or work using Internet platforms and (or) mobile applications of platform employment;

1-1) to allow the driver to drive a passenger taxi after signing an employment contract with him in accordance with the Labor Code of the Republic of Kazakhstan;

2) excluded by the Law of the Republic of Kazakhstan dated 04/19/2019 No. 249-VI (effective ten calendar days after the date of its first official publication);

3) ensure the passage of pre-trip technical inspection of vehicles, pre-trip and post-trip medical examination of taxi drivers;

4) excluded by the Law of the Republic of Kazakhstan dated 04/19/2019 No. 249-VI (effective ten calendar days after the date of its first official publication);

5) ensure timely replacement of the taxi in case of its malfunction;

6) ensure that the passenger is informed about the cost (price) of the taxi service;

7) if there are ten or more invataxis;

8) ensure compliance with the work and rest conditions of taxi drivers.

The taxi carrier also has other responsibilities in accordance with the laws of the Republic of Kazakhstan.

2-1. An individual engaged in the provision of services or the performance of work using Internet platforms and (or) mobile employment platform applications fulfills the requirements specified in this article independently.

2-2. Control over compliance by an individual engaged in the provision of services or performance of work using Internet platforms and (or) mobile employment platform applications with the requirements set out in this article, with the exception of subparagraph 7) of paragraph 2 of this Article, is assigned to the taxi information and dispatch service.

3. When organizing the transportation of passengers and luggage by taxi, the carrier has the right:

1) use specially equipped taxi stands for taxi parking, boarding and disembarking passengers;

2) to board and disembark passengers on any sections of the road network in compliance with the requirements of traffic regulations;

2-1) have a taxi information and dispatch service or conclude an information and dispatch service agreement;

2-2) equip the vehicle with a taximeter;

3) submit recommendations to local executive authorities on the organization of specially equipped taxi stands.

A taxi carrier has other rights in accordance with the laws of the Republic of Kazakhstan.

4. A taxi information dispatch service established by another person other than a taxi carrier shall conclude an information dispatch service agreement with taxi carriers included in the register of individuals engaged in the provision of services or performance of work using Internet platforms and (or) mobile employment platform applications, individual entrepreneurs and legal entities. persons who have submitted a notice of commencement of activity as a taxi carrier.

Information about individuals engaged in the provision of services or the performance of work using Internet platforms and (or) mobile applications for platform employment, individual entrepreneurs and legal entities who have submitted a notice of commencement of activity as a taxi carrier, are posted in the state electronic register of permits and notifications.

5. Local executive bodies of districts, cities of regional significance, cities of republican significance and the capital ensure the organization and equipment of taxi stands, the organization of engineering infrastructure for electric charging stations at airports, train stations, stationary retail facilities of category 1 and 2, shopping markets, theaters, circuses, cinemas, cultural and leisure organizations (parks culture and recreation), as well as squares, avenues, streets, and neighborhoods.

6. Taxi passenger and baggage transportation services must comply with the requirements of this Law, the Rules for Passenger and Baggage Transportation by Road, regulatory legal acts of the Republic of Kazakhstan and national standards.

This Law regulates the relations that arise between carriers, passengers, shippers, consignees, and other individuals and legal entities in the field of road transport.
