Article 27. Competence of the Akimat of the region, the city of republican significance, the capital of the Law on Local Government and Self-Government in the Republic of Kazakhstan

1. Akimat of the region, the city of republican significance, the capital in accordance with the legislation of the Republic of Kazakhstan:

1) performs regulatory, implementation and (or) control functions that ensure the solution of tasks of local importance within the relevant administrative-territorial unit;

1-1) (excluded by the Law of the Republic of Kazakhstan dated 04.12.2008 N 97-IV (for the procedure of entry into force, see art. 2);

1-2) submits the draft regional budget, the budget of the city of republican significance, the capital to the relevant maslikhat in accordance with the budget legislation of the Republic of Kazakhstan;

1-3) submits to the relevant maslikhat and the audit commission of the region, the city of republican significance, the capital an annual report on the execution of the regional budget, the budgets of the city of republican significance, the capital;

1-4) adopt a resolution on the implementation of the decision of the regional maslikhat and maslikhats of the city of republican significance, the capital on the relevant budgets for the relevant financial year;

1-5) is excluded by the Law of the Republic of Kazakhstan dated 03.12.2013 No. 150-V (effective from 01.01.2014); 1-6) (excluded by the Law of the Republic of Kazakhstan dated 04.12.2008 N 97-IV (for the procedure of entry into force, see art. 2);

1-7) forms the budget commission of the region, the city of republican significance, the capital, approves the regulations on it and determines its composition.

In case of consideration of issues affecting the interests of private business entities, representatives of the National Chamber of Entrepreneurs of the Republic of Kazakhstan are involved in the work of budget commissions in accordance with the legislation of the Republic of Kazakhstan.;

1-8) Approves the regional financial plan and the financial plan of the city of republican significance, the capital for the first quarter of the corresponding financial year in cases stipulated by the budget legislation of the Republic of Kazakhstan.;

1-9) ensures the inclusion of energy conservation and energy efficiency measures in the development program of the relevant territory, concludes agreements in the field of energy conservation and energy efficiency improvement, and carries out information activities in the field of energy conservation and energy efficiency improvement;

1-10) ensures the implementation of state policy in the field of energy conservation and energy efficiency improvement;

1-11) ensures the implementation of the state policy of the executive branch in combination with the interests and needs of the development of the relevant territory;

1-12) develops and approves the forecast of socio-economic development, submits the development program of the region, the city of republican significance, the capital for approval by the maslikhat and ensures its implementation;

1-13) adopt regulatory legal acts ensuring the solution of tasks of local importance and the implementation of state policy in the relevant territory;

1-14) exercises control and supervision over the activities of individuals and legal entities within the relevant territory in cases established by the laws of the Republic of Kazakhstan.;

1-15) develops rules for regulating migration processes in regions, cities of Republican significance and the capital in accordance with the standard rules for regulating migration processes in regions, cities of Republican significance and the capital, approved by the authorized body for Population migration;

grave graves 1-16) develops rules for burial and organization of grave care activities in accordance with the standard rules for burial and organization of grave care activities approved by the central authorized body for state planning.;

1-17) develops a draft regional symbolism based on the rules approved by the authorized body on the use of state symbols of the Republic of Kazakhstan.;

2) manages the regional, city of republican significance, capital communal property, implements measures to protect it;

3) promotes the implementation by citizens and organizations of the norms of the Constitution of the Republic of Kazakhstan, laws, acts of the President and Government of the Republic of Kazakhstan, regulatory legal acts of central and local government bodies;

 3-1) participates in the implementation of state policy in the field of science and scientific and technical activities within the limits of competence;

4) creates conditions for the development of entrepreneurial activity and the investment climate in the territory of the region, the city of republican significance, the capital;

4-1) ensures the implementation of trade policy;

4-2) develops and implements a set of measures for the development of stationary retail facilities within the framework of territorial development programs;

4-3) organizes exhibition and fair activities;

4-4) determines and approves the locations and (or) routes for the placement of non-stationary retail facilities;

4-5) provides state support measures for social entrepreneurship in accordance with the Entrepreneurial Code of the Republic of Kazakhstan;

4-6) creates conditions for the development of science and scientific and technical activities within the limits of competence;

4-7) decides on the location of electric charging stations;

5) ensures the rational and efficient functioning of the agricultural sector;

6) in accordance with the scheme of allocation of the productive forces of the Republic of Kazakhstan, it develops a scheme of regional planning of the region, general plans for the development of the regional center, the city of republican significance and the capital, submits them for consideration to the maslikhat of the region, the city of republican significance, the capital; acts as a customer for the construction, reconstruction and repair of regional facilities, cities of republican significance, the capital of communal property and socio-cultural facilities of regional significance, cities of republican significance, the capital, grants permission for the construction of utility networks and structures, including communication facilities; develops district planning schemes for administrative districts, master plans for the development of regional centers, cities of regional significance and submits them to the regional maslikhat for approval;

6-1) monitors planned construction (reconstruction, expansion, modernization, major repairs) of facilities in the subordinate territory of facilities and complexes;

7) organizes the construction and operation of water pipes, sewage treatment plants, heat and electric networks in communal ownership, and other objects of transport and engineering infrastructure, communication networks;

7-1) organizes and conducts prospecting and exploration work for groundwater for settlements; - Excluded by the Law of the Republic of Kazakhstan.

7-2) ensures the operation and maintenance of airfields (airports) owned by the municipality;

7-3) provides places with electricity supply for the construction of antenna-mast structures and (or) supports for cellular or satellite communication equipment by cellular or satellite operators upon their application;

7-4) ensures the organization and control of the uninterrupted operation of emergency services systems;

7-5) subsidizes the costs of water supply and (or) sanitation organizations for repayment and servicing of loans from international financial organizations involved in the implementation of projects for expansion, modernization, reconstruction, renovation, maintenance of existing assets and creation of new assets in settlements, in accordance with the procedure determined by the authorized body in the field of housing relations and housing and communal services;

7-6) subsidizes the costs of water supply and (or) sanitation organizations for repayment and servicing of bond loans attracted for the implementation of projects for the construction and reconstruction of wastewater treatment plants;

7-7) organizes the design, construction and maintenance of engineering infrastructure (roads, bridges, power transmission lines and other communications) to tourism facilities located in specially protected natural territories of national and local significance, as well as to tourism facilities and tourist accommodations located outside populated areas, taking into account the migration routes of animals without providing land use rights or private property rights;

8) regulates land relations in accordance with the land legislation of the Republic of Kazakhstan;

8-1) regulates water relations in accordance with the legislation of the Republic of Kazakhstan;

8-2) organizes the separate collection, processing and disposal of municipal waste;

8-3) decides on the creation of industrial zones of national or regional importance;

9) within the limits of its competence, organizes the relevant state environmental expertise, issues environmental permits for category II facilities, conducts environmental protection measures, and regulates environmental management;

10) ensures the construction, rational operation and maintenance of roads of regional importance;

11) ensures compliance with national standards;

11-1) excluded by the Law of the Republic of Kazakhstan dated 07/21/2011 No. 468-IV (effective after ten calendar days after its first official publication);

12) organizes the protection of public order and security in the territory of the region, the city of republican significance, the capital;

13) organizes the transportation of passengers in accordance with the legislation of the Republic of Kazakhstan in the field of transport;

14) ensures the realization by citizens of the Republic of Kazakhstan, Candace, as well as foreigners and stateless persons permanently residing in the territory of the Republic of Kazakhstan, of the right to a guaranteed amount of free medical care and medical care in the compulsory social health insurance system;

14-1) provides measures in the field of healthcare, including monitoring the implementation of standards for the provision of medical workers in the region, with the exception of activities funded from the national budget;

14-2) monitors the staffing of public health organizations, timely professional development of medical workers, participates in the distribution of young specialists;

14-3) carries out state control over the safe operation of attractions and equipment for children's playgrounds;

14-4) carries out state control over the safe operation of sports equipment intended for mass sports;

14-5) organizes medical organizations in the penal (penitentiary) system (somatic, psychiatric and tuberculosis hospitals (departments), organizations providing outpatient and polyclinic care) to provide medical care to convicts;

14-6) organizes the provision of medical care to persons held in pre-trial detention facilities and institutions of the penal (penitentiary) system, including the prevention and treatment of socially significant diseases and diseases that pose a danger to others, including medical care as part of an additional volume of medical care;

14-7) ensures the realization by foreigners and stateless persons identified and identified as victims of human trafficking in the territory of the Republic of Kazakhstan of the right to a guaranteed amount of free medical care according to the list and in the amount determined by the authorized body in the field of healthcare;

14-8) identifies acute medical specialties in rural settlements;

14-9) provides a one-time monetary payment to medical workers of acute shortage specialties who have arrived to work in rural areas for a period of at least five years, in the amount of one hundred times the minimum wage established by the law on the republican budget and effective on January 1 of the corresponding fiscal year.;

15) ensures the realization by citizens of the right to free education, including primary, basic secondary and general secondary education;

15-1) provides training for participants in the electoral process;

15-2) ensures the quality of education in state pre-school organizations, organizations of primary, basic secondary and general secondary education, including evening (shift) education, and general secondary education provided through boarding schools, technical and vocational, post-secondary and additional education (with the exception of educational institutions in correctional institutions of penal correction (penitentiary) systems);

16-2) performs other powers in the field of providing social and other assistance to persons released from institutions of the penitentiary system, as well as those registered with the probation service, in accordance with the legislation of the Republic of Kazakhstan;

17) coordinates the provision of social assistance to socially vulnerable segments of the population;

17-1) form consultative and advisory bodies to facilitate the activities of institutions and bodies executing criminal penalties and other measures of criminal legal impact, as well as the organization of social and other assistance to persons who have served criminal sentences;

17-2), within their competence, ensure the implementation of state policy in the field of employment by carrying out measures to promote employment, as well as the implementation of other measures to promote employment, financed from budgetary funds;

17-3) establishes quotas of jobs for persons registered with the probation service, as well as persons released from institutions of the penal system.;

17-4) coordinates the provision of social, legal and other assistance to persons registered with the probation service in accordance with the legislation of the Republic of Kazakhstan;

17-5) ensures the provision of special social services to persons released from institutions of the penal system, registered with the probation service, recognized as persons in a difficult life situation, in accordance with the legislation of the Republic of Kazakhstan on special social services;

17-6) promotes the employment of convicts serving sentences in institutions of the penal system, including by:

placing orders for goods, works and services produced, performed and provided by enterprises and institutions of the penal system;

attracting business entities to open, expand and modernize production facilities using convict labor on the territory of penal institutions;

17-7) ensures, with the consent of parents or other legal representatives, that minors with disabilities who are registered with the probation service are referred for psychological, medical and pedagogical consultations.;

17-8) provides housing certificates at the expense of budgetary funds;

18) organizes work on the protection and use of historical and cultural heritage, promotes the development of historical, national and cultural traditions and customs of the population, the development of physical culture and sports;

18-1) carries out state control over the use and maintenance of historical and cultural monuments of local significance, as well as scientific and restoration work on historical and cultural monuments of local significance and archaeological work, with the exception of work on historical and cultural monuments of national and international importance, the creation, maintenance and protection of green spaces located within the boundaries of the region, cities of national importance and the capital;

19) coordinates the work of district (cities of regional significance) akimats, akims of districts in the city on issues within their competence, including the creation of legal and organizational conditions for the establishment and development of local self-government;

19-1) establishes and communicates to the district (city of regional significance) akimat the limit on the staffing of executive bodies funded from the district (city of regional significance) budget, within the general limit and standards for the staffing of local executive bodies approved by the Government of the Republic of Kazakhstan;

19-2) has the right to allocate additional staff no more than once a year in excess of the minimum standards for the staff of akims of villages, towns, rural districts, approved by the Government of the Republic of Kazakhstan, within the general staff limit of local executive bodies.;

19-3) approves a draft design for the construction of facilities on the lands of the state forest fund under their functional jurisdiction, in which forest resources are provided for long-term forest management for recreational, historical, cultural, tourist and sports purposes, hunting needs, and secondary forest use.;

20) in accordance with the legislation of the Republic of Kazakhstan, submits proposals on making decisions on borrowing to the relevant maslikhat.;

21) form consultative and advisory bodies on interdepartmental issues with the involvement of representatives of the National Chamber of Entrepreneurs of the Republic of Kazakhstan on issues affecting the interests of private business entities, in accordance with the legislation of the Republic of Kazakhstan;

21-1), within its competence, provides electronic services using information systems in accordance with the legislation of the Republic of Kazakhstan on informatization;

21-2) ensures the maintenance and filling of the Address Register information system;

21-3) excluded by the Law of the Republic of Kazakhstan dated 24.11.2015 No. 419-V (effective from 01.01.2016);

21-4) develops and approves, in coordination with the authorized body in the field of informatization, the regulation on the registration procedure and address structure in the Address Register information system;

21-5) carries out organizational work on the creation of territorial councils of local self-government and develops regulations on territorial councils of local self-government;

22) creates state institutions and enterprises, sets a limit on the staffing of executive bodies funded from the regional, city of republican significance, capital of the budget within the limits and standards of staffing approved by the Government of the Republic of Kazakhstan. The staffing of internal affairs bodies funded from local budgets is determined in accordance with the legislation of the Republic of Kazakhstan.;

22-3) carries out licensing, permitting procedures, and receiving notifications in accordance with the legislation of the Republic of Kazakhstan on permits and notifications.;

22-4) coordinates the decisions of the state revenue body at the place of registration of the taxpayer on changing the deadlines for fulfilling the tax obligation to pay taxes received in full to the regional, city of republican significance, capital budget;

22-5) excluded by the Law of the Republic of Kazakhstan dated 05.07.2006 No. 166 (effective from the date of its official publication); 22-6) excluded by the Law of the Republic of Kazakhstan dated 07.07.2006 No. 174); 22-7) excluded by the Law of the Republic of Kazakhstan dated 05.07.2011 No. 452-IV (effective from 13.10.2011);

23) develops and submits for approval by the Maslikhat draft rules for awarding the title of "Honorary Citizen of the region (city, district);

24) collects, analyzes and provides to the authorized body in the field of state stimulation of industry information on the domestic value in the procurement of organizations according to the list approved by the Government of the Republic of Kazakhstan, in the form and within the time limits established by the legislation of the Republic of Kazakhstan;

25) formulates a list of goods, works and services produced in the territory of the region, the city of republican significance, the capital, and their manufacturers;

26) organizes activities for the prevention of terrorism and extremism, as well as minimizing and (or) eliminating the consequences of terrorism in the territory of the region, the city of republican significance, the capital through anti-terrorist commissions;

26-1) participates in the prevention of social emergencies, as well as the minimization and (or) elimination of their consequences in the territory of the region, the city of republican significance, the capital;

26-2) in coordination with the national security bodies of the Republic of Kazakhstan and the internal affairs bodies of the Republic of Kazakhstan, develops and approves a list of facilities vulnerable to terrorism located on the relevant territory of the region, city of republican significance, capital, with the exception of military units and institutions of the Ministry of Defense of the Republic of Kazakhstan, facilities of special state bodies of the Republic of Kazakhstan, as well as protected object 26-2) in coordination with the national security bodies of the Republic of Kazakhstan and the internal affairs bodies of the Republic of Kazakhstan, develops and approves a list of facilities vulnerable to terrorism located on the relevant territory of the region, city of republican significance, capital, with the exception of military units and institutions of the Ministry of Defense of the Republic of Kazakhstan, facilities of special state bodies of the Republic of Kazakhstan, as well as protected objects, specified in Articles 1-3 of the Law of the Republic of Kazakhstan "On the State Security Service of the Republic of Kazakhstan", and provides notification to the owners, owners, managers or other officials of facilities on the inclusion of these facilities in the list;

27) transfers ownership of citizens' dwellings from the communal housing stock on the terms stipulated by legislative acts of the Republic of Kazakhstan and in accordance with the procedure determined by the Government of the Republic of Kazakhstan;

27-1) finances and implements measures to improve the sustainability and safety of housing in flood zones, provide life support to the population in possible emergency situations, and build housing for the temporary relocation of the population from flood zones;

31) provides housing for champions and prize-winners of the Olympic, Paralympic and Deaflympic Games in accordance with the Law of the Republic of Kazakhstan "On Physical Culture and Sport";

31-1) provides persons with disabilities with conditions for access to spectacular cultural and mass events, as well as physical culture, recreation and sports facilities for physical culture and sports, and the provision of special sports equipment.

Persons with disabilities of the first and second groups and children with disabilities under the age of eighteen use the listed services at the expense of budgetary funds, and persons with disabilities of the third group – with payment of fifty percent of the cost of these services.;

32-1) analyzes information on the implementation of the investment program (project) of a natural monopoly entity included in the local section of the State Register of Natural Monopoly Entities;

33) develops and submits for approval to the Maslikhat rules for the improvement of territories of cities and settlements, developed on the basis of standard rules for the improvement of territories of cities and settlements, approved by the authorized body for architecture, urban planning and construction;

33-1) develops and submits for approval to the Maslikhat rules for the creation, maintenance and protection of green spaces.

Akimats of the regions, the capital, and the city of Shymkent develop and submit to the Maslikhat for approval rules for the creation, maintenance, and protection of green spaces, developed on the basis of standard rules for the creation, maintenance, and protection of green spaces, approved by the authorized body in the field of protection, protection, restoration, and use of flora.;

34) approves the standards of consumption of utilities for gas, electricity, water, sanitation and heat supply for consumers who do not have metering devices;

34-1) carry out an inventory of telecommunications and cable sewerage networks built at the expense of budgetary funds, and also provide them for property lease (lease) in accordance with the legislation of the Republic of Kazakhstan;

35) implements the development of national and territorial clusters;

36) makes decisions on the establishment of restrictions (suspension) of the right to use wild plants in accordance with the legislation of the Republic of Kazakhstan;

37) ensures the inclusion of measures on land development and use in the development program of the relevant territory;

38) issues an opinion in the cases provided for in paragraphs 3, 5 and 6 of Article 29 of the Law of the Republic of Kazakhstan "On Trademarks, Service Marks, Geographical Indications and names of places of origin of goods".

39) ensures cooperation with non-governmental organizations, individuals and legal entities on socio-economic support for persons (families) in difficult situations;

40) conducts information and explanatory work in the mass media on the implementation of state family policy;

41) organizes measures to identify and organize support for persons (families) in difficult situations and to ensure employment of the population;

42) develops and approves territorial programs and action plans for socio-economic support for persons (families) in difficult situations and other assistance in accordance with the legislation of the Republic of Kazakhstan;

43) develops and approves indicators for the effectiveness of early detection and organization of support for persons (families) in difficult situations;

44) participates in the development and implementation of the main directions of providing comprehensive support to persons (families) in difficult life situations, in accordance with the legislation of the Republic of Kazakhstan;

45) creates and (or) organizes the activities of family support centers in districts and districts in cities under local executive bodies for social protection and employment of the population;

46) creates and (or) organizes mobile groups for early detection and organization of support for persons (families) in difficult situations, with the participation of subjects for early detection and organization of support (education, health, internal affairs) under the coordination of the local executive body for social protection and employment;

47) coordinates the activities of the district departments of social protection of the population to ensure the interaction of subjects for early detection and organization of support (education, health, internal affairs) for socio-economic support of persons (families) in difficult situations.;

48) assesses the effectiveness of the activities of subjects in early detection and organization of support (education, health, internal affairs) to persons (families) in difficult situations.;

49) identifies and maintains records, collects, analyzes the causes, and systematically monitors statistical data of individuals (families) in difficult situations;

50) creates and (or) organizes the activities of psychological support centers under local executive bodies in the field of education.

1-2. The Akimat of the city of republican significance, the capital, develops rules for the provision of social assistance, setting the size and determining the list of certain categories of needy citizens based on standard rules approved by the Government of the Republic of Kazakhstan.

1-4. The akimat of the region, the city of republican significance, the capital holds a discussion of the draft regional budget, the budget of the city of republican significance, the capital at a meeting of the public council established in accordance with the Law of the Republic of Kazakhstan "On Public Councils".

2. The Akimat of the region, the city of republican significance, and the capital exercises other powers assigned to it by the legislation of the Republic of Kazakhstan in the interests of local government.
