Article 27. Powers of the Notary Chamber of the Notary Law
1. Notary Chamber:
1) carries out the general management and coordinates the activities of private notaries;
2) represents and protects the rights and legitimate interests of its members in government agencies and non-governmental organizations, and provides them with assistance and assistance in the development of notary business;
3) ensures that private notaries comply with the legislation of the Republic of Kazakhstan on notaries, professional and ethical standards;
3-1) organizes work on compliance by private notaries with the legislation of the Republic of Kazakhstan on countering the legalization (laundering) of proceeds from crime, financing of terrorism and financing the proliferation of weapons of mass destruction;
3-2) summarizes the practice of applying the legislation of the Republic of Kazakhstan on countering the legalization (laundering) of proceeds from crime, the financing of terrorism and the financing of the proliferation of weapons of mass destruction and makes proposals for its improvement with the annual provision of such information to the Republican Notary Chamber in the form and within the time limits established by the authorized financial monitoring body;
4) submits a submission on suspension, deprivation and termination of the license of a private notary;
5) organizes insurance of civil liability for obligations arising as a result of causing harm as a result of notarial acts;
5-1) informs the territorial judicial authorities about cases of evasion by private notaries from concluding a contract of compulsory insurance of their civil liability and violation of other requirements of the legislation of the Republic of Kazakhstan on compulsory insurance of civil liability of private notaries;
6) organizes internships for persons applying for the right to engage in notarial activities;
7) reimburse the costs of the examinations appointed by the court in cases related to the activities of its members;
8) excluded by the Law of the Republic of Kazakhstan dated 02/15/2021 No. 5-VII (effective ten calendar days after the date of its first official publication);
9) considers the appeals of individuals and legal entities on issues of notarial activity;
10) organizes professional development of notaries;
11) keeps records of notarial acts performed;
12) places it on its Internet resource:
the list of members of the notary Chambers is up to date;
Notary's Code of Ethics;
regulations on the professional development of notaries;
decisions taken by the General meeting of the members of the Notary Chamber, the Board of the Notary Chamber;
summary of the work of the disciplinary commission of the Notary Chamber;
a report on the financial and economic activities of the notary chamber, including information on all receipts and expenses for each specific area separately;
reports on the activities of the Notary Chamber;
and other necessary information about the activities of the notary chamber.
13) carries out an order for the production of seals of private notaries and issues them in accordance with the requirements of the legislation of the Republic of Kazakhstan;
14) sends the seal impressions and signature samples of private notaries to the territorial body of justice.
1-1. Board of the Notary Chamber:
1) organizes the work of the notary chamber in providing legal assistance to individuals and legal entities;
2) convenes a general meeting of the members of the notary chamber, organizes the execution of decisions of the general meeting of the members of the notary chamber;
3) admits to membership in the notary chamber, excludes from membership in the notary chamber;
4) submits generalized reports on the activities of the notary Chamber to the Republican Notary Chamber;
5) excluded by the Law of the Republic of Kazakhstan dated 02/15/2021 No. 5-VII (effective after ten calendar days after the date of its first official publication); 6) excluded by the Law of the Republic of Kazakhstan dated 02/15/2021 No. 5-VII (effective after ten calendar days after the date of its first official publication);
7) submits to the licensor, in relation to the notary, a submission on suspension, deprivation and termination of the license of a private notary;
8) analyzes, summarizes and distributes positive work experience;
9) disposes of the funds of the notary chamber in accordance with the procedure determined by the charter of the notary Chamber and the general meeting of the members of the notary Chamber;
10) organizes accounting, financial reporting, record keeping and the formation of primary statistical data;
11) determines the procedure for disposing of the property of the notary chamber;
12) resolves other issues related to the activities of the notary chamber, except those referred to the exclusive competence of the general meeting of members of the notary Chamber.
2. When considering the issue of compliance with the requirements of the legislation of the Republic of Kazakhstan by a private notary, the Notary Chamber has the right to require the notary to provide information about the notarial acts performed, and, if necessary, personal explanations, including on issues of non‒compliance with professional ethics.
3. Based on the results of the half-year and the year, the Notary Chamber provides the Republican Notary Chamber and the territorial body of justice with information on its activities on paper and (or) electronic media.
