Article 28. Legal capacity of persons undergoing social adaptation between the ages of sixteen and eighteen The Law on Family-type children's villages and Youth Homes

      1. Persons undergoing social adaptation between the ages of sixteen and eighteen years old make transactions with the consent of the administration of a children's village, an orphanage, a boarding school for orphaned children and children left without parental care. The form of such consent must correspond to the form established by the legislation of the Republic of Kazakhstan for a transaction made by a minor.  

      2. Persons undergoing social adaptation between the ages of sixteen and eighteen have the right to independently manage their earnings, scholarships, other incomes and the objects of intellectual property rights created by them, as well as to make minor household transactions.  

      3. If there are sufficient grounds, the guardianship and guardianship authority may restrict or deprive persons undergoing social adaptation of the right to independently manage their earnings, scholarships, other incomes and intellectual property rights created by them.  

     4. Persons undergoing social adaptation between the ages of sixteen and eighteen are independently liable for transactions made in accordance with the rules of this article and are liable for damage caused by their actions in accordance with the Civil Code of the Republic of Kazakhstan.

     5. Persons between the ages of sixteen and eighteen who are undergoing social adaptation in a Youth Home functioning as an independent legal entity, make transactions with the consent of the administration of this institution.

 

 

The Law of the Republic of Kazakhstan dated December 13, 2000 No. 113-II.

     This Law defines the legal status of family-type children's villages and youth homes established in order to meet the rights of orphaned children and children left without parental care to live and be raised in a family, as well as to comprehensively ensure their moral, spiritual, labor upbringing and education.
