Article 286. Smuggling of items withdrawn from circulation or items whose circulation is restricted by the Criminal Code of the Republic of Kazakhstan, the Criminal Code of the Republic of Kazakhstan

1 Movement across the customs border of the Eurasian Economic Union in addition to or with concealment from customs control or with the deceptive use of documents or means of customs identification, or involving non-declaration or false declaration, or with the indication of knowingly false information in the application for the release of goods before submitting the declaration for goods, including the submission of invalid documents, forged and (or) containing deliberately false information, as well as the illegal movement across the State border of the Republic of Kazakhstan of narcotic drugs, psychotropic substances, their analogues, precursors, potent, poisonous, toxic, radioactive substances, radioactive waste or nuclear materials, explosives, weapons, military equipment, explosive devices, firearms, gas pistols and revolvers, gas weapons with the ability to fire cartridges traumatic effects, pneumatic weapons with a muzzle energy of over 7.5 joules, chilled, signal and throwing weapons, their main (component) parts, ammunition, nuclear, chemical, biological or other types of weapons of mass destruction, materials, equipment or components that can be used to create weapons of mass destruction, as well as materials and equipment that can be used to create delivery vehicles for weapons of mass destruction, weapons and military equipment, in respect of which control of specific goods is established, –

     are punishable by a fine in the amount of up to five thousand monthly calculation indices, or correctional labor in the same amount, or restriction of liberty for up to five years, or imprisonment for the same term, with or without confiscation of property.

2 The same acts committed:

     1) repeatedly;

     2) by an official using his official position;

     3) using violence against a person exercising border or customs control;

     4) by a group of persons by prior agreement;

     5) in relation to narcotic drugs, psychotropic substances, their analogues, precursors on a large scale, –

     are punishable by imprisonment for a term of seven to twelve years with confiscation of property.

3 The acts provided for in the first or second parts of this Article committed by a criminal group, –

     are punishable by imprisonment for a term of ten to fifteen years with confiscation of property.

4 The acts provided for in the first, second or third parts of this Article related to narcotic drugs, psychotropic substances, and their analogues, committed on an especially large scale, –

     are punishable by imprisonment for a term of fifteen to twenty years or by life imprisonment, with confiscation of property.
