Article 3. Coordination and examination of international treaties to which the Republic of Kazakhstan intends to become a party, as well as draft international treaties of the Law on International Treaties of the Republic of Kazakhstan

Article 3. Coordination and examination of international treaties to which the Republic of Kazakhstan intends to become a party, as well as draft international treaties of the Law on International Treaties of the Republic of Kazakhstan

   1. International treaties to which the Republic of Kazakhstan intends to become a party, as well as draft international treaties, after coordination with the interested central state bodies of the Republic of Kazakhstan on issues within their competence, are subject to mandatory legal expertise in the Ministry of Justice of the Republic of Kazakhstan.

     The Ministry of Justice of the Republic of Kazakhstan during the legal examination:

     1) gives conclusions on the compliance of the provisions of international treaties to which the Republic of Kazakhstan intends to become a party, as well as draft international treaties, with the legislation of the Republic of Kazakhstan;

     2) defines the ways in which the Republic of Kazakhstan expresses its consent to be bound by international treaties.

     2. International treaties to which the Republic of Kazakhstan intends to become a party, as well as draft international treaties that have been reviewed by the Ministry of Justice of the Republic of Kazakhstan, are subject to approval by the Ministry of Foreign Affairs of the Republic of Kazakhstan.

     The international treaties to which the Republic of Kazakhstan intends to become a party, as well as draft international treaties submitted to the Ministry of Foreign Affairs of the Republic of Kazakhstan, are attached:

     1) the conclusions of the central state bodies of the Republic of Kazakhstan concerned, confirming the coordination of international treaties to which the Republic of Kazakhstan intends to become a party, as well as draft international treaties;

     2) the results of the legal expertise of the Ministry of Justice of the Republic of Kazakhstan;

     3) the results of scientific legal expertise on international treaties to which the Republic of Kazakhstan intends to become a party, as well as on draft international treaties subject to ratification.

     Ministry of Foreign Affairs of the Republic of Kazakhstan:

     1) excluded by the Law of the Republic of Kazakhstan dated 30.01.2014 No. 168-V (effective ten calendar days after the date of its first official publication);

     2) gives opinions on the compliance of the provisions of international treaties to which the Republic of Kazakhstan intends to become a party, as well as draft international treaties, with the international contractual and other obligations of the Republic of Kazakhstan and on other issues related to their conclusion, entry into force, implementation, amendment, suspension and termination;

     3) defines the types of international agreements concluded by the Republic of Kazakhstan.

 

The Law of the Republic of Kazakhstan dated May 30, 2005 No. 54.

     This Law defines the procedure for concluding, executing, amending and terminating international treaties of the Republic of Kazakhstan.  

     International treaties of the Republic of Kazakhstan are concluded, executed, amended and terminated in accordance with the Constitution of the Republic of Kazakhstan, generally recognized principles and norms of international law, the provisions of the international treaty itself, the Vienna Convention on the Law of Treaties, this Law and other legislation of the Republic of Kazakhstan.
