Article 30-1. Assessment of the professional activity of a judge of the Constitutional Law on the Judicial System and the Status of Judges of the Republic of Kazakhstan

     1. An assessment of a judge's professional activity is an assessment of the level of his professional knowledge and the ability to apply them in the administration of justice, the results of judicial activity and his compliance with the requirements of this Constitutional Law.

     The professional activity of judges is assessed in order to improve the quality of the judicial corps, assess and stimulate the growth of professional qualifications, increase responsibility for strengthening the rule of law in the consideration of cases, and protect the rights of citizens and the interests of society.

     The professional activity of a judge is assessed for the first time based on the results of three years of work as a judge. Subsequently, the professional activity of the judge is evaluated every five years.

     Judges who have twenty or more years of judicial experience are exempt from periodic evaluation of their professional activities.

     2. Excluded by the Constitutional Law of the Republic of Kazakhstan dated 05.07.2024 No. 109-VIII (effective from 01.01.2025).

     3. The professional activity of a judge is assessed by the Commission on the Quality of Justice.

     The Justice Quality Commission consists of nine members – four judges of regional courts, two judges of cassation courts, one judge of the Supreme Court and two retired judges.

     The procedure for the formation and organization of the work of the Commission on the Quality of Justice is determined by the Regulations approved by the President of the Republic of Kazakhstan.

     The methodology for assessing the professional activity of judges is developed by the Commission on the Quality of Justice and approved by the plenary session of the Supreme Court after prior consultation with the Supreme Judicial Council.
