Article 30. State control and supervision in the field of medical services (assistance) The Code on the Health of the People and the Healthcare System of the Republic of Kazakhstan
1. State control and supervision in the field of medical services (assistance) are aimed at preventing, detecting, suppressing and eliminating violations of the legislation of the Republic of Kazakhstan in the field of healthcare by subjects (objects) of control and supervision.
2. The subjects of state control and supervision in the provision of medical services (assistance) are individuals and legal entities providing medical services (assistance).
3. The objects of state control and supervision in the field of medical services (assistance) are divided into two groups:
1) objects of high importance;
2) objects of minor importance.
The list of objects of high and minor importance subject to state control and supervision in the field of medical services (assistance) is approved by the state body in the field of medical services (assistance) in coordination with the authorized body for entrepreneurship.
4. In relation to subjects (objects) of control and supervision in the field of medical services (assistance), control is carried out in the form of inspection and preventive control with a visit to the subject (object) of control and supervision in accordance with the Business Code of the Republic of Kazakhstan.
Preventive control in the field of medical services (assistance) without visiting the subject (object) of control and supervision, the investigation is carried out in accordance with the Business Code of the Republic of Kazakhstan and this Code.
4-1. In the course of implementation and based on the results of state control in the provision of medical services (assistance), rapid response measures may be applied in accordance with the procedure provided for by this Code and the Business Code of the Republic of Kazakhstan.
5. Excluded by the Law of the Republic of Kazakhstan dated 05/21/2022 No. 123-VII (effective from 01.01.2023).
6. The basis for state control in the provision of medical services (assistance) at the request of an individual about harm to the life and health of a patient as a result of medical activity is the disagreement of the patient or his spouse, close relatives or legal representative with the conclusion of an independent expert commission.
