Article 31. Long-term forest management in the areas of the State forest Fund of the Forest Code of the Republic of Kazakhstan
1. Forest resources on the plots of the state forest fund are provided for long-term forest management on the basis of a tender protocol with subsequent execution of an agreement between the state forest owner and the forest user, with the exception of the type of forest management provided for in paragraph 1-1 of this Article.
1-1. Forest resources on the sites of the state forest fund for the needs of hunting, as well as for fisheries, including on water bodies located on the sites of the state forest fund, are provided for long-term forest management on the basis of a contract for hunting and fisheries management concluded in accordance with the legislation of the Republic of Kazakhstan in the field of conservation, reproduction and use of wildlife, with the subsequent execution of an agreement between the state forest owner and the forest user.
1-2. In case of long-term forest management, the following types of forest management can be carried out on the sites of the state forest fund:
1) harvesting of wood;
2) harvesting of oleoresin, tree juices;
3) the use of the plots of the state forest fund for the needs of hunting, as well as for fisheries and fish farming, including on water bodies located on the plots of the state forest fund;
4) use of the state forest fund plots for scientific research purposes;
5) use of the state forest fund plots for recreational, historical, cultural, tourist and sports purposes;
6) the use of plots of the state forest fund for the cultivation of planting material for tree and shrub species and plantation plantations for special purposes;
7) secondary forest management.
2. Forest resources on the plots of the state forest fund are provided for long-term forest management for a period of 10 to 49 years to forest users who have the means, production facilities for forest management and specialists with appropriate qualifications, for the following purposes:
logging of main use (timber harvesting) – from 10 to 15 years;
health, recreational, historical, cultural, tourist and sports - from 10 to 49 years old;
secondary forest management, harvesting of oleoresin and tree sap – from 10 to 15 years;
hunting needs – from 10 to 49 years old;
research goals - from 10 to 49 years old;
the age of cultivation of planting material for tree and shrub species and special–purpose plantations is from 10 to 49 years.
2-1. Citizens of the Republic of Kazakhstan and legal entities of the Republic of Kazakhstan without foreign participation who meet the following requirements are allowed to participate in the tender for securing long-term use of forest resources for timber harvesting.:
1) the availability of a material and technical base on the right of ownership or in trust management: machinery and equipment for felling, skidding, loading and hauling wood, ensuring the fulfillment of the established annual volume of logging and forestry and environmental requirements during logging operations established by the rules of logging on the sites of the state forest fund;
2) the availability of fire fighting equipment and extinguishing agents provided for by the rules of fire safety in forests;
3) the presence of an engineering and technical employee - a responsible executive who has a higher professional education in the specialty (logging, forest engineering, woodworking, forestry), or a corresponding secondary professional education and work experience in the specialty of at least two years;
4) the availability of personnel trained to carry out work on felling trees, cutting branches, skidding, loading and hauling wood;
5) availability of a specialist responsible for occupational health and safety;
6) the availability of a promising five-year plan for the organization of harvesting and processing of wood, indicating the sources of financing activities.
3. In the case of the transfer of forest resources to long-term forest management for timber harvesting, the wood resources on the site of the state forest fund are transferred to the forest user with an area that allows for continuous and sustainable use of wood resources in accordance with forest management materials, but not exceeding the area of the forestry.
4. The provision of forest resources on the plots of the state forest fund for long-term forest management should be carried out in a transparent manner, taking into account the interests of the population living in the relevant territory.
5. Unused forest resources on the plots of the state forest fund, transferred to long-term forest management, are not subject to transfer to the ownership of the forest user after the expiration of the contract.
