Article 31. Rotation The Law on Law Enforcement Service

     1. In order to ensure more effective use of professional potential while serving in law enforcement agencies, staff holding senior positions in law enforcement agencies are rotated.

     The list of senior positions is determined by the head of the law enforcement agency.

     Rotating employees holding senior positions of a law enforcement agency are provided with office housing without the right to privatize for the period of their official duties.

     2. Rotation is carried out on a planned basis by decision of the head of the law enforcement agency once every three years. The decision is made by an order. Rotation to service in another locality is allowed with the written consent of the employee, and in the interests of the service – regardless of the duration of the post and without the consent of the employee, with the exception of the employees specified in paragraph 3 of this article.

     Rotation is performed according to one of the following schemes:

     1) inter-level ("center-region", "region-center");

     2) interregional ("region-region");

     3) intersectoral ("center-to-center").

     3. Rotation related to the relocation to another locality of officials who have (or are guardians of) children with disabilities, including adopted children, or who depend on family members who permanently reside with them and have disabilities of the first or second group, or a parent who is a pensioner at the age established by the Legislation of the Russian Federation. the legislation of the Republic of Kazakhstan on social protection is allowed only with the written consent of these officials. These circumstances must be documented.

     In case of refusal of rotation related to relocation to another locality, employees of this category are offered a position not lower than previously held in the same locality, or by decision of the head of the law enforcement agency, the term of office is extended to three years.

     After the expiration of the maximum term of office, an employee is offered a position in the same locality, taking into account the results of his activities, professional qualities, and length of service in law enforcement.

     In case of refusal of the proposed position, the employee is dismissed from his post and placed at the disposal of the law enforcement agency to resolve the issue of his further service.

     4. The list of senior positions subject to rotation and the procedure for their transfer shall be determined by the President of the Republic of Kazakhstan.

 

The Law of the Republic of Kazakhstan dated January 6, 2011 No. 380-IV.

     This Law regulates public relations related to admission to the law enforcement service of the Republic of Kazakhstan, its passage and termination, and also defines the legal status (status), financial support and social protection of law enforcement officers of the Republic of Kazakhstan.
