Article 321. Waste collection of the Environmental Code of the Republic of Kazakhstan

     1. Waste collection refers to the organized collection of waste from individuals and legal entities by specialized organizations in order to further direct such waste to recovery or disposal.

     Waste collection operations may include auxiliary operations for sorting and accumulating waste during the collection process.

     The accumulation of waste during the collection process is understood to mean the storage of waste in places specially equipped in accordance with the requirements of the legislation of the Republic of Kazakhstan, where waste removed from the place of its formation is unloaded in order to prepare it for further transportation to the facility where these wastes will be subjected to recovery or disposal operations.

     2. Persons carrying out waste collection operations are obliged to ensure separate waste collection in accordance with the requirements of this Code.

     Separate waste collection refers to the collection of waste separately by type or group in order to simplify further specialized waste management.

     3. The requirements for separate waste collection, including the types or groups (totality of types) of waste subject to mandatory separate collection, are determined by the authorized body in the field of environmental protection in accordance with the requirements of this Code and taking into account technical, economic and environmental expediency.

     4. Separate collection is carried out according to the following fractions:

     1) "dry" (paper, cardboard, metal, plastic and glass);

     2) "wet" (food waste, organic matter, etc.).

     5. Mixing of waste subjected to separate collection is prohibited at all further stages of waste management.
