Article 337. Illegal hunting of the Criminal Code of the Republic of Kazakhstan, the Criminal Code of the Republic of Kazakhstan

1 Illegal hunting, including with the use of firearms, pneumatic, throwing, bladed weapons, other types of hunting implements, dogs, hunting birds of prey, horseback, horse-drawn vehicles, if this act is committed with significant damage, as well as illegal hunting with the use of explosive devices or other means of mass destruction of animals, aircraft,, motor vehicles, including snowmobiling equipment, or small vessels –

     are punishable by a fine in the amount of up to three thousand monthly calculation indices, or correctional labor in the same amount, or community service for up to eight hundred hours, or restriction of liberty for up to three years, or imprisonment for the same period, with confiscation of property, with deprivation of the right to hold certain positions or engage in certain activities. for a period of up to three years.

2 Illegal hunting provided for in the first part of this Article, committed repeatedly, –

     is punishable by a fine in the amount of up to four thousand monthly calculation indices, or correctional labor in the same amount, or community service for up to one thousand hours, or restriction of liberty for up to four years, or imprisonment for the same period, with confiscation of property, with deprivation of the right to hold certain positions or engage in certain activities. activities for a period of up to three years.

3 Illegal hunting provided for in the first or second parts of this Article, committed by a group of persons, a group of persons by prior agreement, –

     is punishable by a fine in the amount of up to five thousand monthly calculation indices, or correctional labor in the same amount, or community service for up to one thousand two hundred hours, or restriction of liberty for up to five years, or imprisonment for the same period, with confiscation of property, with deprivation of the right to hold certain positions or engage in certain activities for a period of up to five years.

Illegal hunting provided for in the first, second or third parts of this Article, committed by:

     1) in specially protected natural territories or territories with an environmental emergency;

     2) in relation to rare and endangered species of animals, as well as animals on which a ban on use has been imposed;

     3) by a person using his official position;

     4) causing major damage, –

     is punishable by a fine in the amount of up to six thousand monthly calculation indices, or correctional labor in the same amount, or restriction of liberty for a term of three to six years, or imprisonment for the same term, with confiscation of property, with deprivation of the right to hold certain positions or engage in certain activities for up to seven years.

4 Illegal hunting provided for in paragraphs one, two, three or four of this Article, committed by:

     1) a criminal group;

     2) causing particularly large damage;

     3) a person deprived of the right to engage in hunting by a court verdict that has entered into legal force, –

     is punishable by imprisonment for a term of six to ten years, with confiscation of property, with deprivation of the right to hold certain positions or engage in certain activities for a term of up to ten years.
