Article 339. Grounds and procedure for transfer of creditor's rights to another person of the Civil Code of the Republic of Kazakhstan

     1. The right (claim) belonging to the creditor on the basis of an obligation may be transferred by him to another person under a transaction (assignment of a claim) or transferred to another person on the basis of a legislative act.

     The rules on the transfer of the creditor's rights to another person do not apply to recourse claims.

     2. The transfer of the creditor's rights to another person does not require the consent of the debtor, unless otherwise provided by legislative acts or contract.

     3. If the debtor has not been notified in writing about the transfer of the creditor's rights to another person, the new creditor bears the risk of adverse consequences caused by this. In this case, the fulfillment of the obligation to the original creditor is recognized as fulfillment to the proper creditor.

     4. The specifics of the assignment of the right of claim for certain types of obligations may be established by legislative acts.
