Article 35. Digital condominium of the Digital Code of the Republic of Kazakhstan
1. A digital condominium is a form of ownership in which the rights of joint ownership, use and disposal of distributed digital objects created and used by participants are exercised on the basis of general rules of interaction.
2. The digital condominium includes:
1) individual digital objects owned by the participants;
2) common digital objects shared by the participants for the functioning of the relevant infrastructure.
3. Participants own, use and dispose of digital objects belonging to them, and shared digital objects are used in the manner determined by an agreement or smart contract.
4. Management of shared digital objects is carried out by subjects of the digital environment directly or through an authorized person acting on the basis of an agreement with the participants.
5. The rights and obligations of the participants are determined by an agreement between them or the terms of a smart contract, and are certified by digital records confirming participation and the scope of the relevant powers.
6. The procedure for the creation, operation, accounting and termination of digital condominiums is determined by the authorized body.
