Article 35. Guarantees of advocacy of the Law on Advocacy and Legal Assistance
1. The rights of a lawyer are not subject to restrictions, except in cases expressly provided for by the laws of the Republic of Kazakhstan. Interference or obstruction of legitimate advocacy activities entails liability provided for by the laws of the Republic of Kazakhstan.
2. Identification of a lawyer with the person to whom he provides legal assistance is prohibited.
3. It is forbidden:
to interrogate a lawyer as a witness about the circumstances that became known to him in the exercise of his professional duties;
to claim or require from a lawyer, his assistant, his intern, a person who is in an employment relationship with a lawyer, legal advice, law firm, managers and employees of the presidium of the bar association, as well as from a person in respect of whom the right to practice law has been terminated or suspended, or to attempt in any other way to obtain without the consent of the lawyer and his client's information, materials related to the provision of legal assistance, except in cases established by the laws of the Republic of Kazakhstan.
4. Government agencies and officials may not refuse to grant a lawyer private visits with his client in conditions that ensure the confidentiality of such visits, as well as limit their number and duration.
5. Lawyer's office work, other related materials and documents, as well as lawyer's property, including mobile communications, audio equipment, computer equipment, are not subject to inspection, inspection, seizure, seizure and inspection, except in cases provided for by the laws of the Republic of Kazakhstan.
6. A lawyer is guaranteed the right to ensure his/her safety in carrying out his/her legal activity in accordance with the procedure established by law.
7. The bodies of criminal prosecution and their officials, in cases provided for by the procedural law, are obliged to notify the lawyer of the need for his participation in investigative and other procedural actions within the time period agreed with the lawyer.
8. State bodies, local self-government bodies and legal entities are obliged to provide a written response to a lawyer's request for legal assistance within ten working days.
Provision of the requested information to the lawyer may be refused if the information is classified as restricted information.
9. When executing an accepted assignment, a lawyer has the right to use computers, smartphones and other technical means necessary for practicing law in court in accordance with the procedure established by procedural legislation.
