Article 36. The right of temporary gratuitous land use of the Land Code of the Republic of Kazakhstan

Article 36. The right of temporary gratuitous land use of the Land Code of the Republic of Kazakhstan

     1. Land plots on the right of temporary gratuitous land use may be provided to citizens of the Republic of Kazakhstan and legal entities of the Republic of Kazakhstan.:

     for haymaking;

     state land users;

     for gardening;

     in the form of service land plots;

     for the period of construction of public roads, state-owned and socio-cultural facilities, as well as state social facilities (state secondary schools and preschool organizations, hospitals and polyclinics) in accordance with subparagraph 4-1) of paragraph 2 of Article 16 and subparagraph 8-7) of Article 18 of this Code, the laws of the Republic of Kazakhstan ", "On the status of the Capital of the Republic of Kazakhstan" and "On the special status of the city of Turkestan";

     when restoring degraded and disturbed lands;

     for the duration of the public-private partnership agreement;

     when providing buildings (premises) and structures for temporary gratuitous use in accordance with the procedure established by the legislation of the Republic of Kazakhstan;

     for places of worship;

     in other cases stipulated by this Code and legislative acts of the Republic of Kazakhstan.

     2. The term of temporary gratuitous land use may not exceed five years, except in cases of provision of land plots in the form of service land plots and for the restoration of degraded and disturbed lands, as well as in cases of provision of land plots for the implementation of public-private partnership projects.

     The term of temporary gratuitous land use of the land plot provided for buildings (premises) and structures is determined by the term of temporary gratuitous use of buildings (premises) and structures, including religious ones.

     3. It is not allowed to alienate land plots that are on the right of temporary gratuitous land use, including their transfer to secondary land use.
