Article 370. Inaction in the activities of the Criminal Code of the Republic of Kazakhstan
1. inaction in the service, that is, failure of a person authorized to perform state functions, or a person equated to him, or an official to perform his official duties in order to obtain benefits and benefits for himself or other persons or organizations, or to cause harm to other persons or organizations, if this leads to significant harm, –
with confiscation of property and deprivation of the right to hold certain positions or engage in certain activities for life, it is punishable by a fine of up to two thousand monthly calculation indices, or involvement in correctional labor in the same amount, or public works for a period of up to six hundred hours, or restriction of freedom for a period of up to two years, or imprisonment for the same period.
2.excluded by the law of the Republic of Kazakhstan dated 12.07.2018 No. 180 - VI (entered into force on the expiration of ten calendar days after the date of its first official publication).
2-1. the same action committed by a law enforcement officer –
with confiscation of property and deprivation of the right to hold certain positions or engage in certain activities for life, it is punishable by a fine in the amount of up to three thousand monthly calculation indices, or involvement in correctional labor in the same amount, or in public works for a period of up to eight hundred hours, or restriction of freedom for a period of up to three years, or imprisonment for the same period.
3. the same action committed by a person holding a responsible public position –
with confiscation of property and deprivation of the right to hold certain positions or engage in certain activities for life, it is punishable by a fine of up to five thousand monthly calculation indices, or involvement in correctional labor in the same amount, or public works for a period of up to one thousand two hundred hours, or restriction of freedom for a period of up to five years, or imprisonment for the same period.
4. provided for in parts one, 2-1 or three of this article:
1) caused serious consequences;
2) actions committed by a person or judge holding a responsible public position in a law enforcement agency –
with confiscation of property, deprivation of the right to hold certain positions or engage in certain activities for life, imprisonment for up to seven years or imprisonment for the same period is punishable.
