Article 38. Transfer of an employee to another job of the Labor Code of the Republic of Kazakhstan
1. The transfer of an employee to another job is:
1) changing the job (labor function) of an employee, that is, performing work in a different position, specialty, profession, qualification;
2) assignment of other work, during which the working conditions (the amount of wages, working hours and rest periods, benefits and other conditions) stipulated by the employment contract change;
3) transfer to a separate structural unit of the employer;
4) transfer to another location together with the employer.
2. The transfer of an employee to another job is allowed with the consent of the employee, and is formalized by making appropriate changes to the employment contract and an act of the employer, with the exception of cases provided for by this Code.
3. It is not allowed to transfer an employee to another job if there are contraindications for the employee for health reasons, confirmed by a medical report.
