Article 382. Conditions for the movement of goods across the customs border of the Eurasian Economic Union by members of the administrative and technical staff of diplomatic missions, consular officers of consular institutions, staff of consular institutions, as well as members of their families of the Code on Customs Regulation in the Republic of Kazakhstan
1. Members of the administrative and technical staff of diplomatic missions and members of their families residing with them, consular officers of consular institutions, if they do not permanently reside in the Republic of Kazakhstan, which is the state of residence, and are not citizens of the Republic of Kazakhstan, may:
1) to import into the customs territory of the Eurasian Economic Union for initial acquisition with exemption from customs duties and taxes:
vehicles for personal use for the period of granting privileges to such persons in the Republic of Kazakhstan, confirmed in accordance with the legislation of the Republic of Kazakhstan;
other goods for personal use;
2) to export goods for personal use from the customs territory of the Eurasian Economic Union without paying customs duties.
2. Members of their families residing with consular officers of consular institutions who do not permanently reside in the Republic of Kazakhstan, which is the state of residence, and who are not citizens of the Republic of Kazakhstan, if they also do not permanently reside in the Republic of Kazakhstan, which is the state of residence, and are not citizens of the Republic of Kazakhstan, have the right:
1) to import into the customs territory of the Eurasian Economic Union for initial acquisition with exemption from customs duties and taxes:
vehicles for personal use for the period of granting privileges to such persons in the Republic of Kazakhstan, confirmed in accordance with the legislation of the Republic of Kazakhstan;
other goods for personal use;
2) to export goods for personal use from the customs territory of the Eurasian Economic Union without paying customs duties.
3. Employees of the consular staff, as well as members of their families, if they do not permanently reside in the Republic of Kazakhstan, which is the state of residence, have the right to import vehicles for personal use into the customs territory of the Eurasian Economic Union for the period of granting privileges to such persons in the Republic of Kazakhstan, confirmed in accordance with the legislation of the Republic of Kazakhstan, and other goods for personal use with exemption from customs duties and taxes, if it is provided for by international treaties of the Republic of Kazakhstan or international treaties between the member States of the Eurasian Economic Union.
4. If the international treaties of the Republic of Kazakhstan and international treaties between the States – members of the Eurasian Economic Union for individuals specified in this article, including those who are citizens of the Republic of Kazakhstan and (or) permanently residing there, provide for privileges and (or) immunities to a greater extent than provided for in this article, then such persons in respect of goods transported across the customs border of the Eurasian Economic Union, the scope of privileges and (or) immunities provided for by such international treaties of the Republic of Kazakhstan and international treaties between States is granted – members of the Eurasian Economic Union.
